Uvisa the abuser can be anyone regardless of their status, but you have to have reported it to the police and helped in the investigation of the offense (it has to be a serious offense too not just simple assault), the approval for a Uvisa is about 4 years, and all you get is a work permit valid for 4 years. On your 3rd year of having it then you can apply for AOS.

I will just add that while you're waiting on your number to come up in the queue for a U-visa, you will generally get a prima facie notice and be placed into deferred action and you can get a work permit that way. You can also concurrently file I-765 (c)(14) and I-765WS with I-918, meaning that your work permit would be issued together or slightly after the grant of deferred action.
