No. That is not accurate as far as I know. The Supreme Court case was brought up by the Trump administration, not the Republican states, after legal challenges. As you probably know, the Supreme Court decision did not state the legality or illegality of the program itself. The decision was about how the Trump Administration ended the program without the existing proper review process. So, the states can challenge the Biden Administration’s decision and take it all the way to the Supreme Court. Justice Thomas stated that he thought it was illegal in his dissent if I remember correctly. So, if the states bring up a case based on the legality to the Supreme Court, it can be struck down (with the bigger conservative majority).
So, our only hope is a permanent solution.... that is... a legislative solution....
