Their request makes sense, but I feel badly for those who live in the states that joined the lawsuit - DOJ is asking that at a minimum, the states that did not participate in the lawsuit be left out of the order since they are not claiming harm.

The whole gist of the lawsuit is that TX's proximity to the border and its amount of undocumented residents cause the state financial harm, but that does not mean, nor is it a fact that executive orders cause harm to NY, OR, WI,, etc.

This may be too much for wingers - if it makes sense, they want nothing to do with it.
