That is only if ICE has detained you.
Even if you don't include the ICE part, your status isn't Deferred Action yet. You will submit the I-765 with the I-821D.
The only reason you would put Unlawful Status: DACA is if you are re-applying or renewing your EAD and are already approved for DACA.
The correct answer can be Unlawful Status, Visitor Visa Overstay, Student Visa Overstay , anyway you slice it. I called USCIS myself and that's what they told me.
