You need to get court record and show the dismissal paper and all other documents to an attorney to really figure out the whole story.

But you have been arrested, base on this along, it's a Yes to that question. Whether you want to answer Yes or No is a risk you have to take yourself. If you answer No and USCIS finds out about your arrest record, they can issue RFE or deny your application for lying to them.

I guess if I was never indicted I wasn't charged. I'm just confused this is the only thing holding me back from sending my application. I don't want that to affect the approval since it was a felony case, but then again I do have the certified dismissal paper. But I just don't know what to do since last time I applied they didn't ask any questions, I Don't want to bring it up and for them to say well how did we miss this last time
