Shocking: Utah Group Produces List of 1,300 Alleged Illegal Immigrants

A list of 1,300 accused undocumented immigrants was circulated around Utah this week, frightening the state's Hispanic population and causing a state investigation.

The list contained Social Security numbers, birth dates and contact information for each person. Workplaces are listed, as well as the alleged immigrants' children and due dates for pregnant women. Most of the names are of Hispanic origin. The accuracy of the list is unknown; the Salt Lake Tribune attempted to call several phone numbers on the list, which had been disconnected.

An anonymous group circulated the list to various media outlets and government offices, including a letter that called for officials to immediately deport those listed. The letter included:

"We ... spend the time and effort needed to gather information along with legal Mexican nationals who infiltrate their social networks and help us obtain the necessary information we need to add them to our list."

Those who made the list may come under fire themselves. Utah authorities are now attempting to find out if any state employees produced the list. Creating the list may have been illegal under state law if information was obtained through private state and local databases.

An anonymous group has released a list of 1,300 Utah residents who, it alleges, are illegal immigrants. The list, which was sent to media outlets, law enforcement, and lawmakers, includes the names, addresses, phone numbers, birth dates, and in some cases even Social Security numbers of those suspects, the Salt Lake Tribune reports. Utah’s governor has ordered an investigation to determine if any state employees helped create or leak the list.

It’s unclear how accurate the list is. The Tribune contacted two women on the list at random, and both said they were in the country legally. Nearly every surname on the list is Latino. The leader of one Hispanic organization decried the list, and amazingly, so did a representative from Utah Minuteman Project, saying the list might disparage actual citizens. But he added that he wished he had that kind of data. Then “I might really be able to report some illegal immigrants to ICE.”

Funny how this group is annonymous. It's like they don't want people to know who they are. Hmm. If what they're doing is so right and noble they shouldn't be scared to step up and let people know their identities.

Ok , I work with this type of information and let me tell you, this is 100% traceable.

The only way they could have compiled that type of data is running a particular name against a database. Even if they got "infiltrators", people aren't around disclosing their personal financial and demographic information to acquaintances. This was ripped by an employee (s) at the state's Medicaid office and/or community healthcare center.

I have inside knowledge on how the states' Medical coupon systems work - and the exact order of information gathered, as mentioned in that letter, describes the medical assistant database to a tee. I"ll also tell you that the incrase in demand for medical assistance caused by immigrant women means that many of these same employees owe their jobs to them. In WA, they've cut the budget for healthcare assistance and with the cut went a lot of jobs, which had been created by the same demand for care. But basic economic principles require too much thinking on their part.

Oh, and before I forget to inform you, there is a massive amount of U.S. citizens commiting Medicaid fraud - see it all the time. The persons have employer-based insurance and lie to the state to qualify for medical assistance so they do not have to pay their share of co-insurance (usually 10-20 % of total medical costs after the insurance adjusts for contracted rates). This is the first fraud.

The second is that most aren't married, but live with their significant other or parents, etc. So they lie about their total income and household expenses to avoid responsibility for their medical care costs. It is the ones who are citizens who know how to game the system because they have full access and qualify for all sorts of programs, not the undocumented. So they lie about the total household members to the local DSHS office, and on and on it goes.

If the government doesn't demand accurate proof of income and wages (which can be easily obtained by just bringing in a copy of your W2 form or a couple of payroll deposits or paychecks) and the citizens are ok with this, who are we to say someting, right? But these anti-immigrant "Einsteins" can be easily debunked about their lies regarding healthcare and the undocumented.

I feel this information should be actionable on our part.

Should we be notifying a specific medicaid state office where this leak originated?

The employee (and I say employee because it is most likely a single person) who leaked this presents a major breach of HIPAA (The health insurance portability and accountability act) by leaking PHI (private health information). This has serious legal repercussions.

If we don't regulate, who will

MAJOR violation of patients' privacy. HIPPA and PHI were the first issues at hand that I thought of. And you are right, both present an excellent opportunity to go after these individuals as well as the government. Action should be initiated immediately by those on the list that are U.S. citizens. However, I addressed the points of access and responsibility so that the information gets out there and to disprove the officials' statements that they are going to 'investigate', as if it would take ages to track the people responsible for this. It is all digitized and logged by user id. On a second note, many state laws are not pre-empted by HIPPA (such as the ones covering minors with regards to sexual health and pregnancy) and thus take precedent. However, privacy protection is enforced by both state and federal law. As far as I've seen, no medical information about the individuals has been disclosed to unauthorized parties, but the demographic information was most likely disclosed by an employee (s).

Examples of disclosures for treatment, payment and health operations:

To a nurse, physician or other member of your health care team
third-party payer
business associates
research
funeral directors
Organ Procurement Organizations
Food and Drug Administration (FDA)
Workers Compensation
Public Health
Law Enforcement

And many others...

I smell lawsuits from the people that were on the list. I would because it's a major breach of privacy. Everyone should sue the person that did it and the political group behind it.
