Hello, I have question. So I have no relationship to my father. Must I fill both parents for form I130A? Or can I just put my mothers information? I have no clue about him. :S

If YOU are the US citizen and 21 or over...you can put only your mother's information if needed. Visa numbers are generally immediately available and the process fairly if the parent in question only simply overstayed.

He entered without a visa and without inspection.

Did he ever try using Advanced Parole recently?

If not, then the I-601 Waiver process will be required. My suggestion is heading over to immigrate2us.net as they specialize in that process.

I guess what I meant was that if it was normal for the notices of approval to arrive before the actual EAD card?
Also my wife and I want to go in a cruise to the Bahamas in the next couple of weeks. Do you think it’s safe to go before the interview?

On your personal case, I believe you may have the easiest AOS ever from the information you have given thus far.
Curious about the differences in background checks. I always thought that they were the same for any immigration benefit. FBI fingerprint and name check?

We applied for it when it used to be valid, but it got denied. My main question is does he have to go to his birth country or he can go somewhere else for the adjustment of status? On the I-130 form where it says to put which country they will adjust status, it just has another that it doesn’t guarantee if other countries will accept the case. Has anyone on here gone to another country to adjust besides whatever passport they hold?

From what I heard. You chose the office you would like to interview but then if you have no legal entry they will tell you to go pick it up to the country your native to. And that’s where the tricky part comes where you can get banned for 3-10 years.

Are you guys using a lawyer? Because in this case you guys need one.

No, it has to be within a country he legally resides. Technically, there is just more guarantee of that within his home country. I am also not sure how a US embassy might bring this up and if it is simply legal status within that country or must be permanently legal. Also, I have no idea if they will require evidence of said status in said country as the process continues. However, I do know many countries' embassies/consulates do require that while you are here in the US.

If you think about it...it is easier to print a piece of paper that say "approved" than an encrypted government document with several anti-fraud countermeasures...

On going, I think it would be ok. Usually, an interview is atypically ~four weeks out.

Background for Naturalization form what I understand is more in-depth. The reason being is agencies understand once you gain citizenship...it is difficult to have it taken away through de-naturalization. There is more to it than simply a name check...the background from my understanding cover I believe last I read was 26 agencies. What they entail, I have no idea.

Wow. I had no Idea that it would be that crazy. I always figured by being LPR for long they had your prior history and would therefore only go from there up to the point you apply for USC.
