Hey guys, I am preparing all of my forms to file my AOS package. There are a few questions that I'm not sure how to answer. I have searched this thread and I have found some answers, but I'm hoping someone can help me figure out how to answer some of the questions from the form I485. I really appreciate any help.


For question #16 I never applied and got hired anywhere prior to DACA, I only had some babysitting jobs for cash and helped out at a friend's hair salon for cash but I never filled out an application or anything. Does that count as working without authorization?


For question #23 I saw two answers on this thread. One said yes, DACA and the other one said that DACA didn't count so I'm not sure if I should check mark yes and explain at the end.


Question #17, I was EWI until I had DACA and used AP to clear it out back in 2016.


Question #71 I'm pretty sure I need to check yes since I entered without inspection when I first arrived here.



I can't afford a lawyer at the moment but any advice is highly appreciated!

Are you sure you can’t get a lawyer ? You need to get it checked.
#16 to be %100 honest say yes and explain better on part 14 that you did it to Help family or something to that effect .
#17 is no since you never had a non immigrant status
#23 is no daca doesn’t apply
#71 is yes read the question carefully and literally keyword here is “ever” So yes

Read each question carefully and literally

Hopefully someone in here can give a second opinion

#23 is litterally what DACA is, protection from deportation. I will be sending my packet in with that question answered YES and an explanation stating that I applied for DACA. I don't think you can go wrong with that.

Wow I am scared of 72b. What if someone accrues more than 1 year of illegal presence, leaves the country and then reenters with inspection.?

2. It was my understanding that you can’t sponsor yourself your wife needs to sponsor you and if she can’t them you need a joint sponsor. I think you’ll get an RFE because you attached your W2 and letter of employment for you. I would check that again.
3. Sign everything in black

I agree you cannot use your own income to sponsor yourself. But I believe you can combine, if your spouse is working. That’s another form you have to file. I would also include pictures.

Can you guys state where you got that information from. The I-130 instructions do not ot say anything about the Spouse being required to be working, however it does state that if the intending immigrant is the spouse, his income will be included as her income. There's no mention if a requirement for her to be working.

It’s not for the i130 it’s for the I-864. Only a citizen or lpr can sponsor an immigrant. If you SO doesn’t make enough usually you get a joint sponsor. But if you have an ead you can combine incomes. But you alone as an immigrant cannot sponsor yourself. Get a lawyer you can get RFE
