Thanks for the response. I do not live with my gf and we don’t plan on moving in together until after marriage. We will definitely open a joint bank account and file taxes, etc. do everything together once we’re married. I have heard that you can technically file for AoS 6 months prior to being married (please correct me if I’m wrong) so I might try to file it then. Do you know if my Korean military situation will affect the AoS process or not? In my knowledge, I don’t need to worry about it since I entered with inspection and I don’t need to go back?

I am like 99.99999% sure this is wrong short of some fuckery like filing early, getting an RFE, responding to the RFE, and USCIS deciding that "Meh, they're married now so lets approve it".

Like seriously, I never heard of this.

Yeah... like at a minimum, won’t he need an approved I-130? Which means he couldn’t even AoS without getting married.


Edit: Hire a good attorney. Even if you’re a savant for navigating the complex rules of the US immigration system, an attorney will be beneficial. These people have considerably more experience DOING, and have industry contacts. Not a guarantee, but they will be better able to help you navigate your personal situation and concerns than an Internet forum.

Thanks for the advice. I probably will hire an attorney just for that extra comfort and security. Do you have any idea how much an immigration attorney may cost to help with the AoS? I live in WA state and I just want to know whether to expect a couple hundred or a couple thousand.

That might have been it.

US won't care about your military situation.

If this is just simple spousal AOS, expect somewhere between 750 and 1500 depending on the lawyer plus $1760 for I-130/I-485.

Depends on the complexity but I would think in thousands. Personally, my situation has been extremely frustrating and have gone through multiple lawyers. My current I paid five figures.
