DACA to AOS - Page 325

Hello everyone,

I wanted to share my experience in going from DACA to AOS in case anyone happens to have some related questions or just wants to hear about it.

Married to USC in May of 2018. I'm a DACA recipient, yet I entered the county with I-94 (tourist visa). I submitted AOS paperwork in July, 2018. I hired a paralegal, whom was recommended to me, who charged me $500 to prep and submit all my paperwork. Receipts and bio-metric appointment came quickly; however, the interview appointment notice took a few months, until February/March of 2019. The actual interview took place on March 25th, 2019 in Sacramento (I live in the central valley more towards the north).

The interview was, by far, the smoothest thing of the whole process if you ask me. We waited for about 40 minutes, if not more, before they called us in. If fact, we saw people, who got there way after us, go in before us (who knows). Once in, we got asked like three questions top (where we met, when we got married, can't remember the other question, not that it matters to be honest). Everything felt pretty rushed, as if the officer (interviewer) had already made up his mind about my case. I would say that the interview took less than ten minutes. 40 minutes after the interview, my case was updated to "Producing new card" or something along these lines. The interview took place on a Monday and by Friday, of the same week, the conditional green card was in the mailbox.

Can you briefly provide examples of what you and your spouse shared to prove your marriage was legit? And what kind of questions you were asked in the interview?

Did you apply for a work permit with your AOS application? How long it take for that to be approved?

Thank you so much! I have to admit that it does feel pretty good.

In my case, we took our rent contract, joint bank account statements, pg&e bills, city marriage certificate, and certificate and pictures of our church wedding.


As for the questions we got asked:
Q: where did we meet and how?
A: En Stockton en un baile de la Arrolladora lol (true answer) (and yes, the officer spoke Spanish and directed the whole interview in Spanish).

Q: When did we get married?
A: I gave the date of our civil wedding.

Q: Are you related to Felix Gallardo?
A: No. (I'm from Sinaloa, there were laughs but ultimately the question had to be answered. So go figure.)

Those are the only three questions we got asked. To give you a better feel of the interview, the officer was super easy going (jokes and laughs here and there) and only took copies of our passports, marriage certificate, my visa (he kept the card and just gave me a copy), and like 3 pictures of our wedding (but just because I asked him to lol).

Short answer, I did not.


When I applied for AOS, my DACA had been renewed 4 months prior. So being how my case is/was one of the fastest, I decided not apply for the work permit.

I can't give you a straight answer on how long it would take for the work permit to be approved since I did not apply for one, but if I were to guess I would say that it would have taken less than 4 months. To add a little extra, my process from submission to green card in hand took 9 months.

By the way, my DACA is still current until March 2020.

Thanks for the info. Why did the officer conduct the interview in Spanish? I'm surprised to hear that.

Your guess is as good as mine on this one. My wife was pretty thrown off by this fact too.

It seems most people here have adjusted through marriage. Anyone adjust through relative and with deportation order? Can you share your experience? Thanks

I know someone in the forum apply for AOS and had two ewi as a kid and AP with DACA, is anyone else in the same situation? Did you get approve for a GC

Did they get approved? Through a lawyer? Two EWI's is a Permanent Bar.
