I came to the US with my family when I was 13 years old. My dad is on a business visa. When I turned 21, they told me that I need a different visa status to continue to live in the USA legally. Now I am 25 on a F-1 visa and currently getting my masters. I have been legal ever since I entered USA.

So my question is, if the dream Act does pass, will it have a condition like "must be illegal"? I have read articles recently talking about just illegals to the path to citizenships, but what about people like me who also came here at a young age and managed to keep their legal status throughout.

I know for the new deferred childhood action bill, it says "must be illegal before june 15th 2012" which kind of sucks for me cause I qualify on the other requirements.

Suggestions and comments welcomed.

Unforunately, it won't apply to you. The whole point of DA is to help people who have expired visas or are just completely undocumented (and came in as kids). In other words, not legal people.

@Mashawi,actually Rev_Scholar was right all along.I checked the RPI variation under the law and it does mention that individuals who have any period of legal authorized stay cannot apply for RPI.

It isn't that you don't qualify under the Dream act provision but simply that you cannot apply for RPI,unfortunately.

@Ianus, thanks for your reply. This is a big relieve to hear. The media or mainstream social networking was not addressing issues of legal immigrants so I became bit doubtful if it will even benefit me. However, we can not be sure until the final bill is passed. So fingers crossed.

The Dream Act itself may not, but from my understanding, with the rest of the immigration reform, you (assuming your parents petitioned you, or you'll be getting a STEM degree) will get your green card faster.

I know a lot of legal immigrants are angry and are lashing out at us Dreamers or other undocumented folks, but trust us, you have it much better than we do. We basically have nothing and no hope of getting out of our mess unless this passes. This guy was calling a radio show saying how upset he was because he had to wait 2 years and spend a few thousand dollars on a lawyer while we get to become legal for free.

He forgot to mention that many of us have waited 10's of years (27 in my case), have spent the same amount of money on lawyers, and will be paying yet another fine and fees, and it'd still take 13 years if this passes. I guess people who have it good want to feel like victims too.

Have family petition that is now officially current but with past skeletons, is risky to move forward with AOS. Life is on hold for now until laws and/or government becomes more friendly. Life kind of sucks at the moment but like Al Bundy and the mighty cockroach, I survive.

I read the current S.744 bill currently in the Senate, under section 2103 (Dream Act) it mentions that the alien needs to meet the requirements (5 basic requirements) in order to qualify. Definition of an alien can be illegal or legal through my understanding.

So, legal immigrants who also meet the requirements are also eligible for Dream Act. However, as my earlier message we can not be sure until the final bill is passed.
