My question is:
I entered this country when I was 11 years old. When I entered the country I flew into DFW airport from Mexico City using fake documents. The documents (Visa – Border Crossing) have my picture and fingerprints; for I am wondering if I will be denied DACA. I was 11 years old is it still considered my fault or will I be able to apply?
This is exactly the question I have been discussing with other attorneys, and with USCIS officers. There is no clear consensus. One colleague said that she feels confident that these cases can get approved. But personally, I would not file for a client that entered with fake documents until I see how other people's cases go.
To be clear- the issue is that entry was made with fraudulent documents. Would that make applicant an enforcement priority? Or would the young age at the time allow them to not be found responsible for the fraud?
