No, the B2 was still valid.

I guess what happened is that the exit from the first stay was never recorded. So the second attempt they just let us in and gave us a new I-94.

I do not know exactly what could have happened.


My parents did so many retarded things, never thinking the consequences or doing research...

It's alright. Things happen, I'm sure you're ok. Still run by it with an attorney, just for good measure. Good luck. Also, rates are going up Dec 23, so make sure you pay the right fee when you do file. https://www.uscis.gov/forms/our-fees

For those filling out AOS.. I'm using my husbands tax returns from turbo tax but it's 109 pgs long. What exactly do i print I know they won't look through 109 pgs of taxes for 1 yr.

I forget but is there specifically a 1040A through Turbotax? My husband used H&R Block and we submitted only his 1040A which was a few pages long.

While it good to have an attorney, with immigration it's really up to USCIS. So here is my issue. I got a second RFE for not meeting income. Yes I could get a lawyer, but how exactly will a lawyer make my husband's income meet the federal poverty guidelines? His income last year was $29666.90. This year it's currently at $31000. He has one dependent on his tax returns plus me and him. That's three in the household. Now I put on form I-865 that his current income is $30000. But at the time of filling in July it was $19000. My mind is gone blank. All ideas are welcome

Okay so I found out the problem. USCIS uses the total income on IRS form 1040 line 22. Unfortunately due to the way his taxes were prepared his income is just over $19000. Which is not enough! This I did not know.

You're welcome yes please go ahead and mail your forms. I double checked our cover letter for the I-864 and we only sent in 2 pages of my husband's 1040A form for 2014 (since we filed last year) and I believe the W-2 was extra that was all we sent for tax returns. We took the bulk of documents to our interview and only showed them if they asked. Good luck my friend!!!

If you have a family member or someone that is willing to have joint sponsor for your I864, that exceeds that income requirement do so.

My hubby is self-employed, although he has multiple assets, we still had to ask my brother for joint sponsor just incase it wasn't sufficient.

I don't know why I psych myself out all the time. This feels like DACA all over again, waiting.

How much evidence do you put? What evidence did you guys provide for bona fide marriage?

I feel as though I didn't put enough evidence. I put joint bank statements (just 3 month's worth because it would have been a lot), Amazon invoice from 2012 showing he bought me gifts with my name, an invoice from the purchased engagement ring, my CC statement with new marital name, and car insurance with both of our names on it. Also, pictures from the past 5 years. (Like pictures with family and friends, our college graduation, etc.) I had notes from Edible arrangements that he bought me but no date, so I didn't bother to include it.
