Not sure if it means they are ramping things up at USCIS again, but one can hope

I applied late October to remove conditions on my GC with a finalized divorced and I got my 10 yr card Monday! So it too almost 4 months. It was a cake case tbh. I’m surprised it took this long for a damn renewal.

congrats bro. sent my I751 last week, VAWA. Haven't received a receipt/check hasn't been cashed yet. I guess its waiting game for me now

Oh wow that’s great! Did you send your ROC 3 months before green card expired? I’m supposed to send my packet this December. It’s also awesome that you didn’t have to go for a second interview. I’ve heard of people that during ROC attended a second interview but maybe due to pandemic they’re waving it for now. Anyways congrats!

I’m not sure if second interview only applies to still married couples. I was divorced when I applied and I applied like a month before it expired.

Hi everyone! Happy 2021.

I am currently dating a USC girl and things are going really well. She knows of my situation and supports me in every single way. At this point, we’ve talked about marriage after a year of dating. We are both sure we’re “the one” for each other (such a good feeling!) and I’m excited to spend the rest of my life with her!

My question is: do you guys recommend using an immigration attorney to make sure everything goes smoothly even if it costs more? I’ve been looking at this thread and it looks like some people were successfully able to do it on their own. I know it really depends on the situation so here’s a bit more info in my case.

I am currently 27. I was born in S. Korea, came to WA state back in 2002 on a visitor visa (which means I entered with inspection) and overstayed. I fall under DACA (my sis was born here so she’s a USC). The only weird complication is that since Koreans are required to have mandatory military service but I’m in the US, I haven’t done it yet. I was able to delay it while I was in college but wasn’t able to delay anymore so I think I’m considered a criminal now in Korea? I’m not sure if that affects me at all since I don’t need to go back to Korea via AP since I’m not EWI.

With all that being said, do you guys know if it should be a pretty smooth process of getting AoS once I’m married? Or should I hire an immigration attorney just to be safe?

I hired an immigration lawyer for my peace of mind. Hiring one or doing it on your own is up to you and your ability to handle all of the paperwork and supporting documents. Do you currently live with your gf or have joint finances? If not, I suggest co-mingling of finances and plan to moving in together. For the AOS to go smoothly, USCIS has to believe you are married in good faith and not for GC so as much evidence as you can provide helps. Once married, open a joint bank account together, file taxes together etc.

We will definitely open a joint bank account and file taxes, etc. do everything together once we’re married. I have heard that you can technically file for AoS 6 months prior to being married (please correct me if I’m wrong) so I might try to file it then. Do you know if my Korean military situation will affect the AoS process or not? In my knowledge, I don’t need to worry about it since I entered with inspection and I don’t need to go back?
