My DACA was just denied. It feels like my world is crumbling..

I applied for DACA early december, a few weeks ago I received a letter asking for more evidence about my 'brief and innocent departure.' I had left to go study a semester of college in Mexico, and I made sure to put that in my application, along with my report cards from the schools, translated and all.

I got a letter a few weeks ago asking for an explanation for a month that wasn't accounted for in my report cards (July.) I wrote my reply explaining that during that month I was taking the entrance exam, going through orientation and finding a place to live, etc etc.

I got an email saying that I had been denied my worker authorization, but nothing in regards to my DACA, but I was still a little bit worried. Just a few minutes ago I checked my mail and I saw that my DACA had been denied because the attending officer had determined that my absence was not brief, casual and innocent.

I don't know what to do, nor do I know if I have any other alternatives now. I'm thousands of dollars in debt to my roommate and going back to live with my parents is not an option, that environment is toxic.

Could anyone shed some light as to what I can do now?

I feel so lost.

Wow, so sorry to hear that. I mean a month is really brief in the big picture. Did you send them proof of when you came back in?? Like traveling records?? I think you can reapply again. Did you do it with a lawyer this time or self filed??

I did it self filled, I didn't have the money for a lawyer. I sent them travel records for my return, but not my departure, since my email got hacked and I had to get a new one. From what I've been reading I can't re-apply unless USCIS conducted a clerical error, which they didn't.

Ohh, so wait, quick clarification, were you gone a whole semester or just a month?? I wish I could be of more help, I'm sure someone will reply and maybe give you more options cuz the only thing I can think of now is wait for the immigration reform to pass. Don't lose hope!

My semester went from Jan - May. Idk if it's the same in Mexico, but 5 months is quite a bit of time to be out of the country. They might have denied you because of the time you spent out of the country, not necessarily the reason you were gone.

You could always try to speak to a lawyer. There are many that offer free consultations. Depending on where you live, there might be organizations that may be able to assist you.

so basically what I am understanding, he left to study in Mexico for a semester which is not a month, even in Mexico, he then wasn't able to provide for a month in that semester he was gone. Your departure was NOT brief at all.

I am just looking here and already I am seeing 5 months

I would recommend you to reapply again ( you cant open this case anymore but you can reapply) but you would probably get denied again seeing how you are basically showing you departure was not brief

Sorry to hear that, but there isn't much you can do because a whole semester is a long time. Your hope right now is CIR. You will not be included in Dream Act because you didn't live in this country continuously for 5 years. Also you need to somehow get yourself out of debt before it's too late, good luck.

I think it may b the semester plus a month or more of looking for housing and doing tests
