Does anyone know what the next court schedule for DACA with Judge Hanen is all about? Is there a chance he might strike it down or have some type of ruling that might affect DACA? What is the hearing about precisely?

December 22nd. Hearing if Obama followed the correct procedures and if he didn't then it's gotta go. Some are saying whatever he rules (most likley that DACA is illegal) it will be stayed, meaning his ruling will be put on pause as the order is appealed. Most likely to the supreme court

if that's the case (DAPA precedent), then I fear for DACA. I don't remember there being a 30 or 90 day announcement back then.

DACA will most likely be gone thanks to Hanen. But I think we may have some time to continue to review because people have been relying on it for eight years now. They could just say no more renewals even while appeals.

If the only issue they are bringing up is there wasn't public comment than can't Biden (when he is in office) theoretically go through the correct procedure and reinstate DACA that way?

Original DACA did have a 60 day comment period, however. Remember how it was announced on June 15, 2012 and we couldn't file until August 15, 2012 at the earliest?

eDACA and DAPA didn't go through a comment period and that's how it ended up getting killed.

It’s almost as if the Obama administration skipped the comment period on purpose so that the EO could be killed in court. I doubt that they were that incompetent.

And this shit started once DAPA was announced. DACA was untouched until then... wish Obama had not started with DAPA. I can imagine and comprehend the outrage with DAPA.

DACA has sympathy because every single one of us were a minor when we arrived - whether we were 1 or 15 years old.
