Hi, guys.

So, this might be a little different and wasn’t really sure where to post.

My mom acquired who she says is a great lawyer to try to adjust an EWI. Yesterday she received a letter from NVC stating USCIS approved her immigrant visa petition. The letter has a case and invoice number, as well as instructions to continue. It also states her interview will be based in Juarez.

Considering all the shifty lawyers, I’m trying to do my own research to see if this is valid, the norm, and hopefully a solution for her. Her siblings are all green card holders and USC, and my grandma (her mom) is now a USC who is quite old of age now. My bother is a USC, and I’m a DACA holder. Apparently the lawyer asked for documentation from everyone as a way to build a case of why she should be allowed to stay/return.

Does this seem normal? I would hate for mom to be trying to do the right thing and end up stuck in Mexico with a 10 year ban. Let me know if there are any questions.

The the fact that she has a visa available to her is great news. Now, regarding your question:

Are you sure her last entry into the US was without inspection (EWI)?
If yes, has she been in the US (illegally) for more than one year?

If you answered "yes" to these questions, I believe she needs to make sure she has an I-601A application approved before she leaves the country.

You can also check with a different lawyer.

After the I130(immigrant petition) approval for Ewi the next step is the 601a waiver. Is this what the lawyer is doing now?

There's also a facebook group about 601a where you can ask more questions with fellow members who are going thru the same process.

This is a little confusing..... I didn't know NVC sends letters confirming immigrant visa petition approvals. Shouldn't that come from USCIS or the local consulate if she is out of the country? Either way if she has inadmissibility time accrued then she would need a waiver to leave and return.

She hasn’t left since she entered decades ago. She left briefly for a funeral but came back as EWI.

I asked her if the lawyer is doing this next and she said yes. I mentioned she should not leave until it is approved.

Apparently so. She sent me a photo of the letter and envelope. This is why I’m verifying it sounds right. According to her, the lawyer is now working on the 601A next. I mentioned to her not to leave until that is approved.

As you can imagine, I don’t want her to be locked out so I’m just cross checking everything. Attached is the envelope address from the NVC.

was your mom's petition done before 2001? 245i coverage perhaps.

No, this is a fairly recent development. Might have to do with the timing of my grandma becoming a USC? Not sure.

I got one of those envelopes a few years ago but it was notifying me that I should proceed with my immigrant application via consular processing since I had an approved I-130. Check with a reputable immigration attorney.

Hey guys. Someone told me there is no point trying to adjust as an EWI through marriage.

Am I being mislead?
