The irony is that a temporary solution can become a permanent fix to someone's status.One just requires the right of Permanent residency in the US to stay permanently and that can be done via updating Registry to a more current year,whether 1996 or otherwise at the Administration's discretion.

Even if the Executive order was reversed by another administration it wouldn't matter because the undocumented status in question been updated to that of Permanent resident and any undocumented that couldn't apply simply would be able to.....but the rights of Permanent residency for those who were affirmed cannot simply be changed unless Congress decided to vote so which would seem very unlikely,imo.It would also not benefit just dreamers but all would qualify who meet the updated requirements.

^^^Great points! I'm sorry but this Obama administration just enjoys using us with no intention(s) of providing us with relief, just BS and lies.

Is possible to move the registry date without congress? Since the registry provision is in the INA I wouldn't see how it's possible to do it administratively. Correct me if I'm wrong.

What date would they move that to?

I'd like to know too, but I think it's been tossed around as an option here and I can't remember if the conclusion was that only Congress can move the date or not. I'll search through some old threads and see what I can find.

Edit: I found two discussions about the registry provision: here and here.

I couldn't find a definite answer on whether Congress has to be involved, but the administration is against using the President's executive powers to change it.

This is what I can't stand about what Obama is doing:
1. He didn't work on immigration in 09' when he had a greater chance of passing something because there were apparently other problems to work on, like a Healthcare Bill that most Americans don't want. He also wanted 'bi-partisanship' yet he passed that Bill with practically only Democratic support.

2. He didn't want to work on the Dream Act or CIR when tensions were very high in 2010, because the atmosphere was too 'volatile' at that time.

3. Now that tensions are relatively low on immigration compared to a couple of years ago, he doesn't want to demand a Bill or sign an EO because it's an 'election year.'

4. Last year wasn't an election year, yet Obama still didn't sign anything.

I'm sorry but this guy has a pattern of consistent excuses when it comes to the Dream Act, it's NEVER the 'right time.' If any of us thinks that he'll sign an EO for us if he wins in November then you are really gullible. He'll have excuses then just like he does now. He's totally playing us, that's for sure.

I'm not sure. Some people say that 1996 would be the latest possible date since going any later would conflict with the IIRIRA.

This seems so be all of the provision:
Quote:

Sec. 249. [8 U.S.C. 1259] A record of lawful admission for permanent residence may, in the discretion of the Attorney General and under such regulations as he may prescribe, be made in the case of any alien, as of the date of the approval of his application or, if entry occurred prior to July 1, 1924, as of the date of such entry, if no such record is otherwise available and such alien shall satisfy the Attorney General that he is not inadmissible under section 212(a)(3)(E) or under section 212(a) insofar as it relates to criminals, procurers and other immoral persons, subversives, violators of the narcotic laws or smugglers of aliens, and he establishes that he-

(a) entered the United States prior to January 1, 1972;

(b) has had his residence in the United States continuously since such entry;

(c) is a person of good moral character; and

(d) is not ineligible to citizenship and is not deportable under section 237(a)(4)(B) . 1/
I don't see conflict, but I'm no expert so, who knows?

Thanks freshh! I guess the administration doesn't even want to consider changing the date. Maybe its possible to sneak a line into a bill in Congress. All that needs to change is that date.

It was never the right time because he knew they weren't going to do anything until his second term (as said by Rahm Emanuel). We got played. What he failed to realize was that this was and is his election to lose. And quite frankly I'm going to enjoy watching him explain these deportations during the debates. Because Romney is going to move to a more moderate position on immigration and make Obama look like he's failed on that front as well.

I acknowledge the economy was a huge issue and it still is. But, I'd respect him more if he would just come out and say "I messed up. I know that. Work with me and we can and will get this resolved during my second term". Instead we're still getting the same song and dance about it being the fault of Republicans. If I recall correctly we were short Democrats in 2010...not Republicans.

I love this country, but I'm tired of having the shit kicked out of me because instead of our allies actually having the guts to stand up with us, they sit in the background and allow us to be maligned, mistreated and criminalized. Look at the kids in Colorado. Instead of a meaningful gesture or statement, they're being ignored and getting the standard "I support the DREAM Act" spiel from the White House.

Exactly! He'll have a lot of explaining to do this election season. It's funny that after ditching us to work on the economy and health care, the economy is still in bad shape & his health care Bill may be in trouble. He treats us the way a 'playa' would, tells us what we want to hear but does nothing to prove his loyalty, while we make excuses for him. He's not fooling me with his BS anymore, it's put up by signing an EO for Dreamers NOW, or shut up and leave us out of your sick politics.
