Why would he ever cross the border without AP? Having DACA is precious enough, why not follow the rules? I travel A LOT internationally for work and each and every time I would send an application for an AP. Why risk anything?

Not sure which side to believe. If he was righteous, should have gone through with the case.

Maybe he was paid off (starts conspiracy theory...)

Does no one remember this story from months ago? At the time he claimed that he was tricked into signing deportation order even though he had DACA (he was deported within a few hours of being apprehended inside the US near the border; he didn't have his EAD on him) then once he was in Mexico, he tried to cross the border and he was apprehended again. I don't know if he was telling the truth, but that's why the lawsuit started.

Wonder why he dropped the case then. If he was true, given the national attention, he should have gone through the trial.

Maybe drugs were involved?

I'm assuming the documents the government provided showed he was lying or contained information that made a positive outcome unlikely:

According to a motion for dismissal filed late Wednesday, the government resolved the records request by producing supplemental documents on Oct. 5, and Montes decided not to pursue his additional claims. A judge approved the motion on Thursday.
