The ruling doesn't forbid it, but is unlikely to be allowed.

Incorrect.

Nothing in this order prohibits the agency from proceeding to remove any individual,
including any DACA enrollee, who it determines poses a risk to national security or public
safety, or otherwise deserves, in its judgment, to be removed. Nor does this order bar the agency from granting advance parole in individual cases it finds deserving, or from granting deferred action to new individuals on an ad hoc basis.

The order basically leaves it up to DHS's judgement.

All trump has to do, if they find the procedure to be the issue, is to follow the rules and end it.....this is not permanent! We need to push for what we have now!

We have learned that the only solution is an actual permanent legalization.

The time is up. Time for the Dream Act for all childhood arrivals. Daca is perpetual limbo. No, thanks, do not allow this to be an excuse for politicians. And esdpecially the non-profit complex orgs asking for money like NILC and America's Voice.

As much as I want a permanent solution, I expire August of this year and am so relieved to be able to renew for at least two more years of peace of mind rather than the fear and anxiety of losing DACA, my job, and livelihood in a few months.

I feel that things are still too uncertain in terms of a legislative solution that even if they do pass something soon, it will take even more time before they implement. Plus who knows how long it will take to process applications so people who expire this year might become out of status before getting approved.

Debbie downers.trump wants border security. Working for a permanent Daca Fix will give him a legislation win. If anything, this will add a sense of urgency.

This is welcome news for young immigrants enrolled in the #DACA program. However it should not delay efforts in Congress to forge a compromise that would afford them a pathway into the legal #immigration system - @CarloslCurbero

NEW: Looking through DACA news now. 3 important points:
1) This will get appealed. DACA is dead - which is awful but true
2) Says DACA is NOT open to new applicants. Again - DACA gone.
3) This makes it MORE urgent for Congress to act and end this chaos and threat of 800k deported

Seriously, I don't why everyone is happy about this decision. Trump was well within his rights to end this program. If anything, this may halt our momentum towards legalization.

There are pages and pages of legal argument about how it wasn't within his right, so it is up to interpration. Of course, this will be appealed and we have a conservative leaning supreme court so outcome is unlikely to be in our favor.

That's what I don't understand. Will this even take effect, or will will an appellate court just block the judge until it reaches the Supreme Court?

If not and this does allow us to renew, it will probably be months before it reaches the Supreme Court.

Anybody familiar with the appeal process? If this thing never takes effect, then it won’t effect negotiations.

Mine expires in August so I wonder if it would be enough time to renew. Or if we send renewal and SCOTUS blocks this and we lose our money.

This is all so IRONIC, I mean, why didn't they block Trump's decision to rescind DACA when it first happened? Why does it happen now that we are so close to getting something more permanent done? I don't know how to feel about it, as someone said before, it's bittersweet......

If this ruling holds (however long it may), just send that shit in... worst case scenario you'll just get your application back, or if they accept - you'll get a few months off the new EAD.

Most likely you will get your package back, and a refund with an explanation stating why they cant accept it.

This only came about because of the recent lawsuits against Trump's rescinding DACA.
This order basically says since the lawsuits can't be fairly and fully resolved by the March DACA deadline. It's unfair to end DACA, so temporarily DACA should continue.
Just getting this took a ton of work from Dems...

Speaking from experience when my DACA app got rejected I never got a refund. They just sent me a notification letter that I was denied. Consult with a lawyer or someone very knowledgeable first before sending anything in.

I don't think this will change anything or the urgency to pass anything. Activists are already saying on Twitter. The pressure it's still the same because this can be overturned immediately.
