Re: *****RFE Thread <- (Request for Evidence)****

This was my personal experience with "gaps":

I was covered continuously through June 2009 because of my school transcripts, then I took a year and a half after graduation before I went to college. My college transcripts started Jan 2011 until present. When I got the RFE, I was sooo worried about covering all of the months between 2009 and 2010, but the only way to do that would have to be by sending in 18 months worth of bank statements that I didn't wanna wait for, because the bank said it would take 10 business days.

So what I did was send in my medical records. I had had a visit in January, one in May, then August and November. I also found a bill dated for December of that year, and sent it as my RFE as well. Although these 5 items did not prove I was here on every single month, I was still APPROVED after getting my RFE.

So, try to send as much as you can, but dont stress it so much. The officers will use common sense... or so I hope.

:)

I never got a return envelope from USCIS. All I got was the letter with two blue paper inside. One describing what my RFE was for and another that Im suppose to send back.

I packed all my evidence inside of a 9 x 12 envelope with the RFE letter on top. Then i stuck the evelope inside of a post office Express Mail envelope and sent it off.

Same. My lawyer got my RFE with no envelope, the the 2 blue papers asking for a copy of my passport. I put the copies behind the RFE papers inside of a fedex overnight slip and sent it off. like 14 hours later they updated my status that they had received my response so I don't think the return envelope is necessary.

Hey there! I just received a RFE for "Brief Casual and Innocent Absence" stating that I made multiple entries into the US from 2005 to Dec 2008 and that I did not submit sufficient evidence that they were brief and innocent. I did go out of the county briefly during those days and have documents to show evidence of the travel. My questions are: Do you guys think affidavits work well in these cases? I am planning to submit some. Also, do I really have to show proof of the brief departures before June 2007?

You don't have to show evidence of the brief departures before June 2007 however u need to show evidence of any travel after that. If you don't have the travel documents (plane tickets, hotel stay, exit entry stamps) you can have 2 people write affidavits for each departure and also yourself write an overall affidavit to explain your travels. Remember these two people need to have direct complete and consistent knowledge of the travel. The affidavit needs to be sworn and signed before a notary and witness. In case that the affidavit is from a foreign country and in different language, simply have it translated and certified here in the U.S......be prepared to spend!!!!!!!!!!

I have the same case like you and I sent two affidavits for each of my entries plus some travel documents. My case just got routed to Nebraska but I will keep you posted on how it goes.

Hello dreamers, i got my request of evidence yesterday.
Identity and graduate from school.
I sent them a copy of my passport, and i sent them back my transcripts but this time i sent them a letter to them explaining and giving more details about my transcript, i believe this is their mistake.. I dont know why the officer requested my diploma if im still in high school as of august 15, (enrolled on august 6), it states clearly on my transcript that im in adult school right now and that im in process of getting my diploma. It shows the date i enrolled 08/06/2012. And it shows i started school on august 15, i sent my application on august 17, and it might not be the best letter ever but here it is what i said on my letter:

Hello, i'm ....... ......, the applicant for this case, im writing this letter to the ucsis offficer dealing with my case. On october 18, 2012, i received the request for evidence letter in the mail, requesting a copy of any photo identification. Here's a copy of my passport. The second type of evidence was "graduated from school". I believe there's a misunderstanding on my transcripts as i have not graduated from high school and im currently in the process of getting my high school diploma. I have less than . (--) credits left to obtain mi dploma and i should be getting it early next year. My school requires one or two credits per week, and my teacher says i should be graduating in may. I attended ......... High school, from 2007 to 2010 as it shows on this transcript. I had to start attending ....... School when i turned 18 years old. I've been attending that school from 2010- to present. I've read the guidelines from uscis and it states that as long as im currently in school, i should be able to qualify for this program. Thank you for your time to read this letter. My name and then dated.....

What do you guys think? I even highlighted the years from each school, and i highlighted how many credits left i need as of the highlighted date on the copies of my transcripts... I also sent them two copies in color of my passport. Put the notice on top as requested, then my letter, then my passport, then two official transcripts with signatures and stamps from school.
