I came with a tourist visa and overstayed. Am I qualified for I-601A? I've filed I-130 already. I believe USCIS said they have received it but still waiting to take action... I filed about 1.5 years ago.

You don't need a waiver, You need prove that you were inspected at a port of entry.

I-94?

You taking the 601a route? Why if you overstayed and entered legally? You can adjust status easily. Btw 1.5 its alot

Bro what you can do is go the Adjustment of status route and they gove you a work permit/advance parole and it is free with no cost if you are going the adjuster of status

You do need an approved I-601A because if approved. You can go to your 'home' country and interview and if granted Green Card then you can return to USA unless you are covered under 245i. You do this after I-130 is approved and when the time comes for AOS.

Also, if you have DACA and AP, you can return to USA at POE if you were EWI initially.

If you're married to a citizen you don't need the waiver.
If you're married to a permanent resident or it's a family petition, you do need it.

Guys This organization is sponsoring me. My story visa overstayed and already traveled on AP last year. So what is the process of employment ? is there any chance being proved ?

I would not leave anywhere until I have a green card on hand. Actually I would even be willing to wait till I am naturalized.
