LOL. Im confused too! I've always heard (even on thids msg board) how easy it is to file when you are married to a US citizen, etc. I HAVE filed as a spouse and got it approved HOWEVER we received the notice that we have to go to Juarez, MX to get a VISA (he entered illegally with his mom (who is now a US citizen) at the age of 5).

Anyway, I sure as hell ain't goin' to Juarez, and every lawyer we've seen has advised us not to since he could get a 10 yr ban or something like that.

Am I missing something? Does it depend on the lawyer?

EWI with his folks who are both US citizens now. His mom did file for him to no avail, then we got married and I filed as well but we have to go to Juarez and at this point there is no f'in way that'll happen.

I believe you can file a waiver since he is your immediate relative (i.e. a spouse), that should waive the 10 yr ban and he should be able to return when the consular process is completed. Yeah, I may look into that waiver, Im guessing thats the hardship one? And thats the thing, we filed in 2005, thats the same thing the ;awyer said re: Apr 2001- he's even married to an illegal and he's an immigration lawyer :?

I'll look into that waiver though- for now, I have a business he works at and he uses my info for online jobs- the only way to go to survive- blah.

She did, she was able to get hers w/out going to MX & I believe theirs (him
& his sis) was filed way before I met them. Thats why she kept telling us we didnt have to go to MX because she was able to fix herself with just the $1k fine.

She says she can't do anything with her original filing since he got married now (hinting we/he screwed up).

theres not enough words that can explain my disappiontment. Now i am left with a decision on wheather i stay or go back home, but if i stay how much longer do i wait. On the other hand, i would hate to go and it passes in a couple of months. What to do? God please help me

You mention, his mom is a US Citizen? When she became citizen...what age was he? Did she enter the U.S. legally and then stayed or arrived with family illegally? Just wondering..through his mom...why did the atty say there is nothing they can do to help? Sorry,,,,for the questions....

Okay we just spoke with her. The mistake was with their father (who is out of the picture now). He filed for HER but not for the kids in the late 80's. Anyway, she became a citizen a little before we got married 2002/3 THEN filed for him (and hs sister). So it would've been too late (post 2001) anyway.
