Hi. So apparently getting the 601A approved is a massive hurdle? Since I'm just familiarizing myself with this process, I wasn't aware. I saw the letter of approval, it's legit. I hope the rest is a little easier, but her leaving the country makes me so incredibly nervous. What are the usual odds that she gets a visa approved and returns if she has a completely clean record?

Yes, it is a huge pain in the behind.

The 601A application only waives unlawful presence. Your mom should make sure she will not trigger other grounds of inadmissibility when she goes to her interview.

Example:
- Did she enter the US without inspection more than once?
- Did she bring minors across the border without inspection?
- Other?...

She should talk to her lawyer before she leaves the US and be completely honest about her immigration history. Even if it sounds trivial, it may not be under US immigration law.

Thanks for this! I will be sure to pass it along immediately. The lawyer has probably briefed her about it but it never hurts to stress the importance of being 100% honest.

Big question. will a I601A clear my two ewi plus 3 advance parole after that. my two ewi was when i was under 18 now im over 30?

Approved I-601A cures the 3/10 year ban.

DACA AP cures initial EWI.

You re-entered again on EWI? That is a permanent ban. See a lawyer.

Not sure about that one. You definitely do not want to go through the visa process. It looks to me like you already triggered the permanent ban. While, unlawful status does not start until 18 years old, the permanent ban can be triggered regardless of age.

Definitely check with a lawyer and see if you can AOS, since you had advance parole afterwards.

I have 3 EWI’s, two failed attempts after getting caught by CBP and 1 successful, but they all happened in the same month, so I don’t have a permanent bar. If you came then accumulated unlawful presence for 6 months or more then left then came then you have the permanent bar.

Hey Alby, where are you in the process?

I have a similar problem. 1 encounter with CBP and 1 successful EWI a week later.

My lawyer is very VERY concerned I was given "Expedited Removal", but I don't think that was the case. As far as I can remember, I never signed any documents for my return, so a "Voluntary Return/Removal" is very likely. Either way, we are doing a CBP FOIA to find out exactly what happened.
