Long time lurker here. My fiance is in process of getting LPR and hopefully get it in about a year and we are planning for a wedding in late this year or early next year. Once she gets the green card, can I file I-130 and I-601A with my fiance as petitioner? Petitioner doesn't have to be USC for I-130 and I-601A or does it?

No, your spouse does not need to be a USC.

You'll need to submit I-130, wait for it to be approved, then submit I-601A. Each application is currently taking almost one year to be reviewed and hopefully approved. Additionally, I do believe the number of visas available for spouses of LPRs is limited each year. So, you may want to get on it as soon as you can.

I'm doing exactly this, but does anyone know how they react when you submit your i130 as soon as you get married? My plan is to adjust my status, then married my fiance and file his paperwork that same week. We've been together for over 10 years and we are tired of this crap.

Should not be a problem. My spouse and I dated for 2 years before getting married and submitted our I-130 one month after we got married.

Make sure to submit enough evidence showing that the relationship is legitimate, such as pictures with friends and family and documents with both of your names on them:

utility bills
bank accounts
loans
car insurance
etc...

So I got the whole packet back in the mail and they rejected it because I apparently didn’t put the fee receipt from the department of state. I printed it off the NVC website and put it in with everything else. It’s even in the packet they sent back, I don’t get it.

There are two receipts you need to include, the IV and AOS receipts. Did you include both?

I just included the one for the IV. Do I need to send out a new 601A form or just send back the packet they sent back?
