From what i read the info of the children would also be on the nvc forms right. I've read cases where after being denied at the consulate, they applied the 601 waiver and was able to come back to the US.

A: She didn’t get a 10 year ban if she wants to wait 10 years she won’t need the 601 waiver my mom was denied for the same reason thankfully she in the USA already
A:Can you tell us what was her answer so people don’t end up in this same situation *She said that my dad brought us and that she didn’t know. Then they told her that there was no possible way she didn’t know and that if she didn’t know how come she didn’t take us back when she found out.
A:My mom question was right all 4 of your children where born in the USA my mom Answered no only 3 one in Mexico again asked so they where all born in the USA again answered no he asked where the one who is from Mexico she said in Chicago how did she crossed she said I crossed with her she was only 3 months of age he denied her and said thank you for not lying he asked when they checked the birth certificates their was no way of her lying
Q: Ok so what's the law say about of you bring your child here with you and your in process ? Will you be denied I601a and forced to do I601 regular waiver and be banned for some time or forever banned ? And what if you didn't want her or him to come but your spouse or bf made you and then come then this responsible of you've since then left with your child and your still here in USA and so is he but now your married to a US citizen and have hardships can you become legal and or serve jail time for this ?
A:For bringing someone with you it's considered smuggling and they ask for the 601 waiver. That waiver take from 12 to 15 months to be approved. There is no jail time or anything like that. They dont really care if you were forced to bring you child with you or even if someone else brought your child they still consider it smuggling.
