From what I know, she didn’t bring me in. A family friend brought me after my mom had already arrived. She has no double entry and no criminal record here or in Mexico.

By the way, she crossed to Juarez yesterday (sigh) and had her doctor appointment there today, Monday. Wednesday is bios, Thursday is interview.

Well... here's the update I was hoping not to give. She was denied at the consular office by and agent who thought she wasn't telling the truth about how I got here.

The agent told her that she can apply for the I-601 waiver and hope for the best. Others who got denied who were there did not get a told that and were denied outright. As of now, I think processing the waiver takes close to a year? So I won't be seeing her for that long, and that's if it gets approved. Obviously I cannot leave to go see her.

I am horrified and heartbroken. I got so dizzy hearing the news that I almost fainted.

That’s unfortunate news. Sorry to hear that. 601 is taking close to a year, Yes!

So, Did they ask her like who she came with? If she brought anyone?

Was she ever apprehended by CBP? She came illegally?

Did they ask how she came?

On a FB forum, someone’s mom also got denied because of that.
Smuggle ban is common for parents who bring their kids.

I'm still gathering details but she was never apprehended by CBP, she did come illegally, and she came through the desert.

However, I was brought by someone else, a family friend who I was staying with, and was never instructed to bring me by my mom. They brought me to see her when she was already here as a surprise and I stayed. This seems like it will be tricky to prove.

I'm in a panic, someone is coming to try to calm me.

Just calm. At least, she can file for 601.

So, they asked her, if she brought you here? She said No! But still didn’t believe her and denied. That’s scary because then they can just always assume the applicant is lying.

Exactly. This was the question where the agent assumed she was lying, everything else was going fine. But yes, he told her to apply for I-601.. so the lawyers are now scrambling to get this going sooner rather than later. The I-601A was approved in 6-7 months so I'm praying that for some miracle the I-601 is approved in that amount of time.

It's crazy that they can just assume and deny just like that. My LPR grandma needs her here to take care of her, and my USC brother is sponsoring my mom.

Her initial entry was EWI but did she leave and comeback again EWI? Do you have a lawyer?

This make me not want to leave the country for the interview, so much is at stake. I’m so sorry for you and your family.

She did not leave and come back, she has been here since initial entry. A family friend decided to bring me over to surprise her because she had made it. She never got caught or anything. Yes, we have lawyers.

It is such a painful experience but don't let our situation sway you. Every case is different, as are the agents.
