Got my rfe letter yesterday... One additional evidence they are asking for is proof of unlawful status as of june 15, 2012... recommended docs were i-94 which I sent initially which has the date I came and I also sent a copy of my expired student visa, obviously with the expiration date... Do I just copy them and send them again like... I'm confused.

That should be enough. Is there any reason for them to believe that you had a valid status during that date?

I would send those two things again, the copy of the visa and I-94.

Well I also know that I sent docs from 2005- the time i sent the app but nothing from 2003-2005. I a, going to get some information from the middle school I attended those years.

So are they asking for more than one thing? Or just that you didn't have a status as of June 2012?

STUDENT IN UNLAWFUL STATUS AS OF JUNE 15, 2012

You did not submit evidence with your form I-821D to show that you were in unlawful status as of June 15, 2012. You may still submit evidence, which may include, but is not limited to, copies of:

-I-94/I-95/I-94W Arrival/ Departure Record showing the date your authorized date expired.
-If you have a final order of exclusion, deporation, or removal issued on or before June 15, 2012, submit a copy of that order and related charging documents, if available
-An INS or DHS charging document placing you into removal proceedings
-Copies of your transcripts showing your student status from (2003-2013
-Copies of all properly completed old I-120AB forms or new SEVIS I-20 forms for all schools attended

I sent I-94 and F-1 form as well as copy of expired visa (with expiration date) so, I guess just get something from my middle school from 2003-2005 to prove I was in school?

Yes, I am resending it along with middle school letters or anything I can get. Btw, I have been following your posts so long I am starting to anticipate your approval as well lol! :)

so i received the rfe letter in the mail today and well turns out they need info from july 08 to august of 09. and from october 09 t0 may 2012. i dont know who looked at my application but there was not that much of a gap between my documents. anyway good thing is a i came across an old w2 from o9 along with some college forms and credit card junk mail but hey it was dated from 09 and mailed to my name. but idk if i can use that w2 as i used a random ssn at the time. 2011 i have tons of online purchases and well 2012 same along with bank account statements. 2010 is actually the dark horse i have maybe like an xbox live purchase dated and written to me and an email between me and landlord. i did work that year but i was paid cash and well the guy i worked for was also undocumented.

Holy Crap!!! You already received yours???!! i see you got your rfe notification 4 days ago, i got mine 2 weeks ago and nothing in the mail? can i ask you what state you live in?

So, this middle school has been giving me the run around. I graduated in 2005 and according to them all of my files were transfered to the high school when I left but they are saying after 2005 they started storing everything in the computer... So... No one has any records of my middle school years. This is stressing me out. I am about to speak to the middle school secretary today. This is crazy.

Or even just a letter would be nice, saying I attended the school 2003-2005, my picture is in the yearbook and everything.

Your high school doesn't have your entire school record?

Anyways, if you can't get it, don't stress about it. You only need to prove from 2007-present. Unless you want the middle school records to show you arrived before 16.

They said once you leave the high school, they are not obligated to keep your grammar school records just your high school... I spoke to an imm officer though and she said if I could even get a letter from them explaining the whole computer storage situation that would be good. Waiting to get a call back from someone at the school. I really just want to send this rfe asap.

But 2 things though. #1 my visa didnt expire til 2006 so how would the middle school records from 2003-2005 prove any of that? And also if you say they only need from 2007-present, is the middle school records necessary then? Because this is just a huge delay that can be avoided if they don't necessarily need it.

Also, I did (like I said in a previous post) send my i94 which shows the date I came and a copy of my student visa with the date it expired. I also copied these to send again.

You can call the school district and they can give you a copy of your kium and on the kium is file all ur test score and transcripts

My sister got an RFE becauase she forgot to send the copy of her ID (I know stupid) LOL
Anyways, she sent it back the next day. Her case was updated and it said they received the papers already. How long did it take you guys to get approve after them receving it?

hey guys,

my attorney sent the RFE respond yesterday via express mail. he sent me a copy of the receipt when he sent out the package, so i just look at usps to check where the package it and it show that i arrived at the post office today in the morning and is available for pick up.

Is this is normal? would some from uscis/tsc will pick up the package?

My current dilemma is that I did not state any info about myself working a part-time. It's not that i'm working illegally and it's only in a W-2 and an ITIN, however, I don't want to further complicate things.

Are transaction histories a big fuzz with the California Dpt? Maybe I'm over rationalizing... I feel and think that I'd have to send in my tax for my part-time, maybe even having my manager notified; which I do not want. I'll probably send my 2 page monthly transaction and balance, I'm sure seeing the deposits of $100 - $300 isn't a big deal. Besides I reasoned that I'm doing freelance in my WS. That's not even salary figures, right?

I think the only exception for me is that I censored out my Bank Number and Balances in my bank statement sheet, again, bad judgement on me. But I'll send them the same page without the "blackened" censors. I will probably not send in my full transaction records but will probably send extra extra receipts and maybe other statements. I think a transaction history for a month is sufficient enough. What should I do?

They just specified that my bank notice is insufficient and I'm miffed about the continuing statement of "you may", what do they exactly mean by I "may"?

Also what is the format and can someone please pm me, I don't think getting quoted gives notifications either...

Just checked my status, and their asking for additional evidence, upset I got one but also glad they are actually looking at my app. Texas service center. I should get the letter in a couple days.

well it take up to 15 days but in my case i was notified i got a RFE on feb 27 then i wait the two week after waiting exactly two weeks they update my status again that have a RFE and but this time was march 13 and then wait for 5 days more and i got the actual letter

that if you're still waiting 6 months to get approved, but still haven't received an RFE, it means you're case is going to get straight approved?

Cause if they wanted an RFE, they would of sent it earlier, so for ppl waiting longer periods, it means they are in the higher chances of getting approved?

Not really, I have seen people wait 6mnts then got REF on March 21st.
