They ask because it is considered smuggling/human trafficking. I answered no, they were not with me.

If you don't have legal entry or your wife is not a citizen, you have to file the waiver. For that you need the welcome letter from USCIS and tons of evidence. The waiver is the hardest part of the process.

Why did they ask so many questions regarding DACA? Once you have an approved 601A, DACA is irrelevant.

Yeah I am EWI, which is why I need to file the I-601A. My wife is a USC.

You may think it's irrelevant but having DACA shows you had legal means of working in the USA and less likely to be a public charge, my husband made enough to sponsor me but we do our taxes together and it was more than enough so we did not need a co sponsor. Most denials are for not having the waiver or being considered a public charge.

But questions really do depend on the consular officer and each case.

Did you tell them if your parents sent for you?

Yes, they already know because of your age when you crossed that it was your parents or a family member who brought you but they want to hear it from you to see if you are honest. The line of questioning was Did your parents send for you? Did they take possession of you after you crossed? The officer already knew I did not cross with my parents from the previous question.

Does anyone know after 601A when and if it gets approved, when is the I-485 actually filed?
Im trying to get clarification for the timeline after submitting 601A, as well as what other forms need to be submitted and when. I understand after filing 601A, if it get approved then then DS 260 filing should follow... then I-485? or is 485 never filed when it is an empoloyment based petition?

Don't file the I-485; that is for Adjustment of Status... It appears you're going through consular proceedings, so you probably don't qualify for adjustment of status.

1) Submit I-130 (or I-140?), wait for it to get approved
2) Case is sent to NVC. Pay IV and AOS fees
3) Submit I-601A along with IV & AOS payment receipts. Wait for it to get approved
4) Submit DS-260 online form, and documents
5) Wait for interview appointment
6) Go to vista interview at a US Consulate in home country
7) Come back to US

As always, check with a lawyer.

Thanks for clarifying, yes Im doing consular processing. I got confused because in the "repayment agreement" . I had to sign for the company I work for and who is sponsoring me, it says something about filing "I-485 Immigration Petetion for Alien Worker" but It seems they made a mistake and meant filing "I-140 Immigration Petition for Alien Worked".

The lawyer has submitted the 601A with the paperwork I collected . (Based on hardship for my LPR mother). I received a biometrics appointment for Jan 9. After that the nerve racking waiting period to see if it is approved starts for me.
