Hey all,
I need help. Here's my story: 1. Grandpa petitioned in the F3 family category for Married Sons and Daughters in 1996 2. I-130 approved in 1996 3. The wait for the visa to become available begins priority date is Jan 1996 4. The whole family goes to the US on a B2 visa and never leaves in 2001 5. Grandpa dies on 2012 6. Our priority date become current recently - now we can have our visas approved My questions with some context: Context: 1. My brother have married USC's and adjusted status - have a green card - on the way to being a USC. 2. The earliest that one of us can be a USC to petition our parents is end of the year - which is close to the election - and immigration laws can change by then. 3. My parents are still undocumented and grossly overstayed Questions: 1. Can 601-A help? 2. Grandpa is already dead - how can we prove a hardship to a dead person? 3. GrandMa is still alive and is old - can we prove hardship to her? 4. Is it worth it? Should we just wait till the end of the year? Any feedback is appreciated. Please feel free to DM too. FYI, I have my interview date, it's early April. I'm going to contact NVC to reschedule it.

Im at 11 months of my finger prints for my 601a.. still no answer.. getting a little anxious. My case is being reviewed at Potomac Center

Yes they can proceed through this petition via a process known as Reinstatement, basically they need a different family member to sign off on the affidavit of support. The family member can be: spouse, parent, mother-in-law, father-in-law, sibling, child, son, daughter, son-in-law, daughter-in-law, brother-in-law, sister-in-law, grandparent, grandchild, or legal guardian, who's a USC or LPR aged at least 18 years old. If the substitute sponsor cannot meet the income requirements then any USC/LPR can cosign the affidavit of support. |
