i assume since everyone at uscis is a USC, they dont know what we go through thats why they take forever and mostly dont care about our situations,

Re: *****RFE Thread <- (Request for Evidence)****

I m in need of help. I just received an RFE from the Nebraska branch asking for evidence of continuous presence from 2007 to 2011. I entered the country sometime around 97' when i was 12 and have overstayed my Visa ever since my parents brought me here. I've supplied records from middle school to high school and ones that account for my current presence here. Unfortunately,I have been a dependent of my parents after i finished high school and have no income and no personal records of expenses. I also have no assets; everything in my possession is the property of my parents. The only thing i can think of using as evidence are notarized affidavits from family and friends. I can also print out my Ip address from my Facebook logins. Im afraid those aren't enough to account for my continuous stay here. If anyone was in the same position i'm in now, Please let me know how you overcame the issue. I'll be forever grateful for any input in my dilemma.

Re: *****RFE Thread <- (Request for Evidence)****

none that i can recall, I have records for when i got my prescription glasses last year but according to the RFE the evidence for 2012 was sufficient so that's not going to be relevant.

It was for my birth certificate the one I had was marked m instead of f and so my mother in law that lives in mx went to get a copy of it to 'el registro civil' where they have records of births deaths etc and my birth was recorded right but some idiot stamped it wrong. My mother in law brought me the copy and I sent it the next day! Btw I would call my lawyers office every two weeks to check on my case but I got busy with work and a month later I randomly stopped by his office after a dr visit to check on my case. To my suprise that rfe had been sitting in there for a whole month!

i think the longer you wait to respond to a RFE the longer it gets them to approve you.
it took me a month a half to respond to the 1st RFE and three months later, they sent a 2nd RFE which i responded within one week and they received it on October 22nd; so now, i am anxiously waiting and HOPEFULLY i will get something next week.
i hope we all 2012 applicants get approved by the end of this year!

will written affidavits be enough as evidence for RFE?

Atelier 12-01-2013 05:29 AM

Re: *****RFE Thread <- (Request for Evidence)****

It depends on the officer , I literally did not get rfe for a whole year by one affidavit... Some people got rejected with better proof. I got lucky and then I got an actual rfe for continuous residency and I replied with some affidavits that were supported by a couple medical bills and pictures. So they definetly help... but may or not be enough.

I recommend you to not stress about the wait; don't check your case status every five minutes or stuff, I'll make you crazy.

Thanks, this is what I'll be doing. What has to happen will happen...

I did get a RFE kind of quick, so I'm hoping I will get an answer as quick too. But, if they need more time to study my case, and the possibility of getting approved increases, they can take all the time they want

Could you talk about your case? Why did you get denied the first time?
