Release Date: January 15, 2010 For Immediate Release Office of the Press Secretary Contact: 202-282-8010 "As part of the Department's ongoing efforts to assist Haiti following Tuesday's devastating earthquake, I am announcing the designation of Temporary Protected Status (TPS) for Haitian nationals who were in the United States as of January 12, 2010. This is a disaster of historic proportions and this designation will allow eligible Haitian nationals in the United States to continue living and working in our country for the next 18 months. Providing a temporary refuge for Haitian nationals who are currently in the United States and whose personal safety would be endangered by returning to Haiti is part of this Administration's continuing efforts to support Haiti's recovery. "At this moment of tragedy in Haiti it is tempting for people suffering in the aftermath of the earthquake to seek refuge elsewhere. But attempting to leave Haiti now will only bring more hardship to the Haitian people and nation. The international community has rallied to deliver relief to Haiti. Much has already arrived and much more is on its way. The Haitians are resilient and determined and their role in addressing this crisis in their homeland will be essential to Haiti's future. "It is important to note that TPS will apply only to those individuals who were in the United States as of January 12, 2010. Those who attempt to travel to the United States after January 12, 2010 will not be eligible for TPS and will be repatriated. "The Department of Homeland Security continues to extend sympathy to our Haitian neighbors and support the worldwide relief effort underway in every way we can. Four Coast Guard cutters have arrived in Haiti, in addition to a variety of Coast Guard assets that were already in the area to support military air traffic control, conduct damage assessments and rescue people in need of assistance. The Federal Emergency Management Agency (FEMA) continues to work closely with the U.S. Agency for International Development (USAID) and the State Department - the lead U.S. federal agencies in the response - while coordinating the deployment of state and local Urban Search and Rescue Teams from across the country to Haiti and standing by to provide food, water and other resources as requested. U.S. Customs and Border Protection (CBP) has provided aircraft to support response efforts. "Haitians in the U.S. who are eligible to apply for TPS should go to www.uscis.gov or call USCIS toll-free at (800) 375-5283." |

i think thespian is haitian and im also haitian. but i will not be applying!! but i already know some family member who will start applying real soon. but the thing is its only for 18 months. thanx for donating day dreamin. $25 is a lot in haiti, so thank you!!

yeah your right loquito and they can also travel which is a good thing. i doubt they would want to go back home. even though TPS is granted, it's not like they're getting permanent residency. hopefully obama will pass CIR/ DA for the rest of people who are waiting real soon

This question might be obvious but would Haitian Dreamers still qualify for Dream Act if they have TPS?

I'm extremely happy for haitian immigrants that benefit from TPS, Any Status is better than none. And it could maybe act as a gateway to something better, not sure.
Forgive me for asking this though, to everyone else who isn't Haitian, did seeing/hearing about this for the first time today send chills down your spine like it did for me? I couldnt decipher if it was an "urgh" moment or a "Yay!" moment... The feeling i got, i mean. |

Travel Outside the United States
If you have TPS and wish to travel outside the United States, you must apply for a travel authorization. Travel authorization for TPS is issued as an advance parole document if DHS determines it is appropriate to approve your request. This document gives you permission to leave the United States and return during a specified period of time. To apply for advance parole, you must file Form I-131, Application for Travel Document (see form on right). If you leave the United States without requesting advance parole, you may lose TPS and you may not be permitted to re-enter the United States. oh and im not applying for tps because im married to a USC and hopefully i will be granted my GC real soon which mean i can petition for my family members. i did thought about other people getting mad that haitians are getting this but you need to realized it's not something they can have forever nor does it provide them permanent residency. and thespian, i hope you do file real quick and get yourself your license and a job. good luck!! |

yeah your right, it was really quick but they had to do something about this. i do know there's a lot of people who are going to be angry if CIR or DA doesn't pass. they're gonna be mad about the haitians getting TPS.. hopefully everything works out for eveyone

Stilldreamin I know how you felt!........At first i had heard that the government was planning on giving Haitians TPS, then at night I heard that it had been passed. I didn't know how to react. If I should jump of happiness or be sad about it. It was an unknown feeling........I'm glad that at least Haitians dont have to worry about their legal status for 18 months. I'm sure the government is going to extend the TPS longer like they've been doing with El Salvador and Nicaragua. By the way sherry, How is your family in Haiti? were they affected by the earthquake? oh and is your mom and sister applying for TPS?

my dad's house was a little bit destroyed but it's something we can always fix. he broke a few bones. he's actually out there helping other people and driving them around . but i don't know about the rest of my family yet...yeah my mom,little sister and brother are applying. my little sister just want to get her license. my brother is only 14 so i don't know if hes trying to get a job or what lol. im going home next week for two months to help them out with the forms. it's better to do it without a lawyer.

yeah he's one of those people who are sleeping on the street because he's afraid the house might come down. he called me today and he told me that it's going to take 2-3 months to remove all the dead bodies. i want to send him money but he told me the transfers are not working right now. im trying to find a way to send him food directly to him... yeah she's 18

Hey. I wanted to ask does anyone know what would happen if my application was processed and i was scheduled an interview in haiti, if they would allow me to have it here in the U.s or any other place? My dad applied for me and my sister a few years ago and we had an interview scheduled in haiti, since we had been living here, when we left the ban would have kicked in, so we ended up not going. Is there anyway we could have our case reopened and the interview moved to here? also I am currently engaged to a member of the military(for love not to get my status..lol), but i wanted to know if I applied for tps, would that allow us to get married and me not having to leave for an interview? That's why we haven't gotten married yet. It seems no matter what I would have had to leave, then the ban would kick in. any comments or advice would help. Thanks guys.
