Napolitano: Deferred Action Applications Will Be Available on August 15

Quote:

With regards to deferred action, Napolitano said that applications will be available on August 15 and added in her testimony that:

Individuals must also complete a biographic and biometric background check and not currently in removal proceedings or subject to a final order, must be 15 years or older to be considered for deferred action. Only those individuals who can prove through verifiable documentation that they meet these criteria will be considered for deferred action under this initiative. Individuals will not be eligible if they are not currently in the United States or cannot prove that they have continuously resided within the United States for at least five years.

Napolitano reiterated that the program will not cost American taxpayers because there will be a fee for the process (in addition to the $380 for work authorization and $80 for biometrics). It is important to note that DHS has not yet decided the cost of the application.

Looks like we're getting the information we've been dying to hear in terms of timelines and when things will be available.

Get your documents ready, people. Remember the fee that will be associated with this.

Yes. Individuals subject to final orders of removal will be able to submit an affirmative application to USCIS regardless of whether they have reached the age of 15. This process is not yet in effect, and no applications for deferred action should be submitted to USCIS at this time. If your client meets the eligibility criteria and is in danger of imminent removal, you should immediately contact the Law Enforcement Support Center hotline at 1-855-448-6903 (24 hours/day, 7 days/week) or the ICE Office of the Public Advocate at 1-888-351-4024 (9:00 am – 5:00 pm, Monday-Friday) or by e-mail at [email protected].

I have a final order, and I'm hearing yes from one source and no from another. Am I missing something?

I wouldn't worry. This probably means you will have to wait maybe a little longer. But who knows, you will be able to apply in time after all because as you point out, we have been hearing those with final orders are eligible likewise. In fact, you should be first in line.

If you meet the requirements you should apply with a lawyer if you have final order.

.....Biometrics for USCIS is when they take your picture and fingerprints. That very same picture and fingerprint will go on your EAD.AFAIK,Biometrics will only involve USCIS taking your right index finger via Livescan devices they have.USCIS only takes all 10 fingerprints when going for Permanent Residency,Green card renewals or US citizenship.

If you have a Final order don't worry about it.I am quite sure that the process will include taking those with Final order before an immigration judge to have the order closed "Without Prejudice" and then the individual can then get their Deferred action for 2 years.I know of at least 2 individuals this has happened to for different reasons but not under this directive.Government attorneys request cancellation of deportation orders to immigration judges more than a lot of people think and in turn the immigration judge almost always grant the request.

I really hope I won't have to file any other applications like "cancellation of removal".

did you guys see that she was specifically asked if we would be able to get on an air plane?
IF i understood correclty she said yes, the notice of action accompanied by a valid ID should suffice. meaning they can't deport you while the decision on you case in pending. sweet!

I'm not sure if you saw it but read this.I'm very confident about this one individual had a removal order the other a deportation order. The removal order was closed administratively while the Deportation was asked to be closed by government attorneys in front of an immigration judge.Only an immigration judge can make or change a deportation order so....no worries!

Re: Napolitano: Deferred Action Applications Will Be Available on August 15

When i was documented you had to wait for USCIS or DHS to send you paperwork with which you requested an appointment and then got your livescan done at one of their facilities. So must we wait to get the Livescan's done still or can we get a head start of this process by completing that now? Most Livescans once approved give you two years but are only valid for verification for up to 3 months from date of approval. My last Livescan which i did as undocumented for work took 6 months to get approval.

Can't wait to finally get my fucking driver license.
Good thing about NY, once you get a license from then on you only extend it (unless you're a shithead and have it taken away), they never ask you for proof of residency again.

Same in California. My dad has had his for many years, easily renewable online or in a mail form and extended. I am thankful for this. If for some reason they remove this memo, we at least have some means of proper identification to drive/travel/ID ourselves.

Sweet
A week and a half left until they release a guideline for application (Aug. 1) and about a month (Aug 15) until we can start applying for deferred action.
Our lives are getting easier and easier as each day passes. Start gathering documents and money guys, we're almost there. =D
