Assembly Bill 2189, by Assemblyman Gilbert Cedillo, D-Los Angeles, directs the Department of Motor Vehicles to issue driver's licenses to people who are not eligible for a Social Security number but who can submit substantial proof that their presence in the United States is authorized under federal law.

The proposal stems from a Jun 15, 2012, memorandum issued by the federal secretary of Homeland Security, Janet Napolitano, which said that the Department of Homeland Security would defer immigration enforcement actions against undocumented immigrants for two years if they can establish that they came to the U.S. before age 16, have lived here for at least five years, are in school or have graduated from high school, have not been convicted of a serious crime and are under the age of 30.
Cedillo, who has authored several previous proposals to give undocumented immigrants California driver's licenses, said this measure "is about public safety," because it allows for individuals who are already in California to undergo a driver's test.
"This is the right thing to do," said Assemblyman Jose Solorio, D-Santa Ana, who voted for the bill.
All of Cedillo's previous efforts to give undocumented immigrants driver's licenses failed except for a proposal passed in 2003, when Gov. Gray Davis signed the legislator's bill. Davis, however, was promptly recalled and the legislation was repealed by new governor, Arnold Schwarzenegger.
Cedillo's current proposal – his last bill in the Legislature before terming out at the end of this year – may have a better chance. It passed out of the Senate on Wednesday on a 25-7 vote, with three Republicans voting for it, including Sen. Tom Harman of Huntington Beach. Also voting for the bill from Orange County was Sen. Lou Correa, D-Santa Ana.
In the Assembly on Thursday, Cedillo's bill garnered two more Republican voters, plus the vote of Assemblyman Nathan Fletcher of San Diego, who dropped out of the GOP during his failed run for mayor of that city. Still, 15 Assembly Republicans voted against the bill while another 10 abstained. The bill passed on a 55-15 vote.
"We cannot continue to undermine the rule of law," said Assemblyman Brian Jones, R-La Mesa, in a comment typical of others made by Republicans in Thursday's evening debate. "This is a federal issue that requires federal legislation."
In Assembly, only two Orange County lawmakers supported the bill, Solorio and Assemblyman Tony Mendoza, D-Artesia, whose district includes a piece of Buena Park.
Gov. Jerry Brown’s staff would not indicate whether he would sign the bill, saying that it is his office’s policy not to comment on legislation before it reaches his desk. Brown has until the end of September to sign or veto the bill.

Hopefully but I doubt it... I-797c ( if that is what you are referring to ) is basically just a receipt that we filed and paid our dues. An approve Deferred action should suffice this requirement.

Exactly! It say yu don't need a SSN soo this is my question how do we prove it if we got no social then we got no permit!
So is the I-797?

If the i-797c is sufficient then, it will be alot easier for the dreamers to wait for their work permit.

After re-reading the article, I think it means if you fail to qualify for the work permit but you qualify for deferred action, you can still use that letter to get a DL in CA? Kinda weird though, because if you qualify for DACA shouldn't that also qualify you for the work permit (Ead)?

Exactly, so submitting an approved Deferred action form should fulfill the eligibility requirements.

That way once deferred action is given to you then you wouldn't have to wait 90 days for your EAD before applying for a DL.

The primary goal is to shorten your DL wait.

No work permit is if you can establish economic necessity.

There you go, Deferred Action and EAD are 2 applications of their own. They probably let us submit both at once so the process would be a lot smoother and easier.

Once your Deferred action is accepted then they'll figure out whether to issue you an EAD or not

This California bill would let you apply with an approved Deferred Action instead of EAD so that way you can drive while waiting for your EAD so it seems.

The question is, how long do we have to wait to find out if we are approved for Deferred action?
I mean since we submitted 2 application at once, wouldnt they give out the results at the same time?

hahaha wow youre so defensive, im just saying if you paid your lawyer 4k to MAIL a simplr application, I would make my money worth it and ask as much as you can, but DACA is as new to him/her as it is to the rest of us.

3 to 4 months after Biometrics

EAD have always been issued aroumd this time period after Biometrics

once your application is sent to a processing center, it takes like 90 days for them to approve the I-821d, then i think another 90 days to get approved for the EAD, now that time can be shorten based on workload and what not. And judging from the time ppl are getting biometrics, atleast the first xxx ppl will get theirs at a shorter time frame

And is an I-797 approval notice for Deferred Action eligible for a SSN? In other words, if you don't get a work permit, can you still get a social security number based on the fact that you've been approved to stay in this country and would like that number to get a DL?

I hope when we start receiving our employment authorizations and approval for DACA people who have previously gotten licenses can let us know what we need to get one :) In california if you are over the age of 18 do we still require a permit before taking our driving test?

Mr brown received the bill, (with the other 1000+) on fri Aug 31st i believe. Lets say the 4th cause of the holiday weekend, so whether he signs it or not, i hope the bill will pass on its own on oct 4th? thats my opinion, i have no idea when will dmv will get to actually apply it thought. i usually google the ab 2189 and look into the news section to see the recent updates and nothing new. Hopefully he will sign it before but seeing as dreamers are getting their EAD before I-821d approval it won't matter. Hopefully the early cali apps will get theirs very soon and use the EAD + ssn to get driver licence, as without the bill those 2 items (plus others) will get u the id/dl with a 2 year limit on em :/. I hope with the bill though it would gives us a normal expiration date like everyone else appose to the 2 year limit

Okay. Can someone from CA dumb this down for me? I just found out about this. Does it mean we have to wait for the Governor to sign a bill so we can get our licenses? Or does it mean that we can head to the DMV once we are approved? I was just approved three days ago and I'm hoping my card arrives tomorrow so I can head to the SSO. But if I can kill two birds with one stone and head to the DMV as well then that would be amazing.

That's a dumb and redundant law. You'll be able to get your DL no matter what. Once you go to the SSA, they will tell you that it'll take up to a month before you receive you SSN, but they'll give you a letter. Try taking that to the DMV along with your EAD. Let us know how it goes?

umm the way the bill is worded is what concerns most of us as it says we can get a dl just with the approval letter of I-821d, meaning no ssn required. That would let people who didnt qualify for the I-766 (work permit) still get a d.l and no ssn.
he has til tomorrow, ugh.. i got my ead and waiting on ssn, so i hope it takes into affect soon for the rest of u guys, im gonna wait for my ssn print out :D

When did you apply for your SSN? When do you think you'll get the print out? I got my EAD approved on 9/19 but didn't get it til the 24th. I applied for my SSN on the 24th.
