Obama Sets Monday Deadline for Appealing Immigration Order

(Bloomberg) -- The Obama administration set a Monday deadline for a federal judge to lift his order blocking a controversial immigration program or it will appeal the decision.

The White House told U.S. District Judge Andrew Hanen in Brownsville, Texas, of the new deadline in an advisory filed the day after 26 states, led by Texas, urged Hanen to keep his restriction in place while their lawsuit challenging the policy is decided.

The Obama administration has already appealed Hanen’s Feb. 16 preliminary ruling that it sidestepped federal rule-making procedures by failing to let the public review and comment on regulations before they’re put in place.

How long do you think it will take if Hanen does not lift the restriction?

I don't think the administration is under any illusions that this judge will do the right thing, but they are lawyers and they have to follow the process. If this goes to the supreme court, we should take a field trip there.

It's not dangerous. It's SMART! It's time Obama and Democrats stop allowing Republicans to set the tone. They always act like chickens with their heads cut off while Republicans look superior. Obama should have BEEN issued that deadline the moment Hanen took it upon himself and decided he would change his decision from Monday to Tuesday and then nothing. By trying to get DACA/DAPA implemented in states that were not a part of the lawsuit he's not allowing the judge or the Republicans to define his executive order. Checkmate.

If that happens, it means my family and many others will be moving to states that are more immigrant friendly, which will benefit those states financially. I still cannot believe they tried to say the states are burdened by driver licenses we pay for. I just find it unfair that people have to uproot their lives and families where many have been for years.

The administration asked Hanen for a stay on his order last month and late on Wednesday requested a decision by Monday.

Hanen on Thursday declined to comment while the case is ongoing.

Hanen, who had previously criticized U.S. immigration enforcement as too lax, based his ruling on an administrative law question, faulting Obama for not giving public notice of his plans. He also cited ways that Texas would be harmed by the action but used no other states as examples.

Anne O'Connell, a professor at University of California Berkeley School of Law, said it is doubtful that Hanen will grant even the partial stay, but said the administration's move appears designed to force Hanen to defend his argument.

"If all the harm is about Texas, it does seem like a bit of overreaching by the judge to keep the preliminary injunction in place everywhere," O'Connell said.

At this point it's better than nothing and its a compromose worth having. By doing this he's forcing their hands because the Republicans will have to answer to those states that are not a part of it come election time. I too will never understand the "burden" Hanen said would be inflicted on these states especially when we're essentially (over)paying our damn selves. Not to mention the billions they instantly obtained when they implemented ID cards and driver's licenses by mandating we had to pay two years of back taxes. I personally had to pay four thousand dollars in back taxes before i could apply for those cards when those cards had a blatant "Not for Federal purposes " stamped on the front like a fuckin' scarlet letter. To turn around and say that obtaining some modicum of dignity would be a "burden" on their states when in actuality it would essentially help them is really a slap in the face.
