Retired Marine Gen. John Kelly promised Tuesday to enforce laws against sanctuary cities and said the solution to rising illegal immigration is to deport more people faster, as he laid out a starkly different direction for the Homeland Security Department under a Trump administration.

Gen. Kelly, President-elect Donald Trump’s pick to lead the sprawling department, said U.S. Border Patrol agents need to be allowed to go after migrants, and he criticized the Obama administration for giving “a pass” to the illegal immigrants caught inside the U.S. and to the cities and counties that shield them.


“I don’t think I have the authority to pick and choose what laws need to be followed. I think it’s, in a lot of ways, dangerous to think you can pick and choose laws,” the nominee told senators at a hearing.

Even his wording represents a stark break with the Obama administration. He used the term “illegal alien” — which immigrant rights advocates protest — to describe unauthorized migrants, and he repeatedly called for closer adherence to laws already on the books.

Despite his hard-line stance, Gen. Kelly’s confirmation is virtually assured. He was introduced to the panel by one senior Democrat, Sen. Thomas R. Carper of Delaware, and another Democrat called the hearing a “lovefest.”


But illegal immigrants and advocacy groups are sounding an alarm. They are demanding to know how Gen. Kelly plans to handle Dreamers, the young-adult illegal immigrants whom Mr. Obama granted a deportation amnesty in 2012.

Gen. Kelly said he was keeping an open mind and that Dreamers would not be top priorities for deportation.

He also declined to say whether he would use information from Dreamers’ applications to target them or other illegal immigrants, nor would he set a target for how many of the estimated 11 million illegal immigrants in the country should be deported.


But Gen. Kelly made clear that he thinks “very large numbers” need to be deported, and quickly.

“I believe that rapidly processing and returning aliens to their countries of origin in significant numbers will help to immediately and significantly reduce the number of individuals and groups trying to enter the country illegally,” he said. “It will not be worth the investment of their life savings to get here, and it will not be worth making the dangerous trip north, if they know they will quickly be put on a bus or aircraft and returned south.”


He said the U.S. also must do more to control drug abuse. He said the national epidemic feeds the cartels and other criminal gangs that have destabilized countries to the south and caused waves of migration.

The four-star Marine general retired after tours that included leading allied forces in Iraq and then heading U.S. Southern Command, where he controlled all American forces in the Caribbean and Central and South America.

The latter experience gave him a close look at the forces driving illegal immigration and at the cartels that control migration and drug trafficking in the Western Hemisphere.


He said the porous U.S. border is the greatest threat to homeland security and that getting a handle on the problem is his top priority.

He was skeptical about a number of other Obama policies, including allowing illegal immigrants to sign up for military service, cutting back on cooperation with state and local police for enforcement of immigration laws, and broad use of “prosecutorial discretion” to avoid deporting most illegal immigrants.

“I believe that there is a role for traditional prosecutorial discretion, but we cannot refuse to enforce the laws on the books,” Gen. Kelly said.


The nominee also backed Mr. Trump’s signature campaign pledge for a wall as just one part of a “layered” approach, which also would include technology and manpower.

The general has not committed to Mr. Trump’s plan for “extreme vetting” of visitors from trouble spots around the world, but he said he shares the president-elect’s goals of keeping foreign terrorists out of the U.S.

i believe he is talking about criminals that get apprehended and released. like the "catch and release" program that sanctuary cities participate in. if you're a law abiding person i doubt something will happen to you.

Sounds like a deport everyone not here legally. And since DACA isn't law, I think he's also talking about us. He said significant numbers... And he also has info on a significant number of immigrants here illegally (us).

DHS is under prosecutorial discretion, like was said before.. all 11 million people can be subject to deportation. but DACA people with be at the bottom of that priority list. There isn't just enough resources to deport that much people and they would have to focus on criminals.

This administration wanted to focus on criminals. To hear the new administration DHS and AG picks, it's my opinion that they'll deport anybody they can. But I am a pessimist usually. Haha

I understand why everyone is being so pessimistic, but they have said numerous times that they are not going to deport us. At the very worst they are putting us at the bottom of the list. I do worry about others tho.

The thing to watch will be if there is any change to the expedited removals category. Right now it includes recent arrivals, which I think is who he was referring to when he said

Unless DACA recipients are placed into an expedited removal category I think we might be fine. Right now immigration court is swamped with 500,000 cases which take several years each. If you add 750,000 DACA cases on top of that then we're looking at several years before we even get a MASTERS hearing and several more until we get a final decision. Easily enough time to outlast a Trump presidency, assuming he is a one term president and the Dems get their act together in time. And remember, the whole time you have a case pending with immigration court, you are entitled to a work permit.

Trump and other Republicans have continually said they will not deport 11 million immigrants. They have continually said only undocumented immigrants with criminal records. For now, I think the questions and responses were poorly worded. Worry when they actually start deporting people with criminal records. Stop acting like it's fucking Armageddon. Dudes need to fucking chill.

Worst case scenario. If Trump cancels DACA and rescinds our work permits.. You can move away from where you currently are, then work in places where they don't have e-verify, that alone will give you 2 extra years,where hopefully you can find someone to marry !! don't wait before it is too late!

Honestly though, I really do not see 11 million people being deported. IF NON-CRIMINAL ONES ARE DEPORTED, THEY WILL MOST LIKELY BE DEPORTED BECAUSE THEY WILL ALLOW THEMSELVES TO BE INTIMIDATED OR SCARED BY IMMIGRATION OFFICIALS. (e.g. "If you do not waive your right to challenge the deportation process, we will go after your family. We know where they live." "You are going to be in a detention center for years without seeing your loved ones." etc). I know they say this type of shit because my dad has been constantly in and out of immigration detention centers. This problem was even the case under the Obama administration.

Please stop thinking and acting like a fucking meteor is going to end our lives and we all screwed. Hell, don't even act like that in front of your friends and family. You will be dubbed a fucking drama queen and become a candidate for being bitch slapped. Guys are taking it too fucking far... RIGHT NOW.

What I find interesting, is that so many of these articles if not all, and so many of the people involved, are always bringing up the DACA peeps.

Maybe this is a sign that DACA beneficiaries is too risky of a group to go after?

Still worried about everyone else though, it seems like it may be open season on deporting undocumented immigrants.

Agents will most likely arrest any undocumented immigrant they come across and take them in for questioning and background checks. But, I do not really see "innocent" ones being deported unless they allow themselves to be tricked or scared.

this is true bruh, always remember this is America... exercise your 5th amendment rights if you are apprehended. And i know uncertainty is everyone's biggest issue right now, we will find out soon enough what happens to us. If this shit does not work out for us, life moves the fuck on guys... always have Plan B's, C's, or even D's.

Remember we are the most sympathetic group of immigrants out of the 11 million. elected officials, majority of the American people, and Trump himself thinks our issue is a "humanitarian" issue.

I would add that those posts were written according to the state of the law as it exists today. Remember that limited financial resources is a very real thing. As much as the Republicans would love to kick all of us out, they have to deal with the reality that funds are limited, ICE agents don't work for free after all. That's why we have deportation priorities to begin with. It wouldn't make sense to start using their limited financial resources on DREAMers when there are a ton of more pressing priorities to deal with first. I think recent arrivals and criminal cases alone are enough to keep them busy for the next 4 years.

Raids might become a thing again to keep ICE officers busy, but not everyone caught up in a raid will be deported right away. Some people caught up in any new raids will be a priority for deportation, like anyone with a prior deportation, or someone who has been detained by immigration before, or someone with a criminal record. But a lot of those people will have a right to due process, even if most of them don't. The one's that have clean records, USC family members, and enough years in the U.S. will have a right to see a judge, further adding to the court case load and processing times and making individual court cases last even longer. And that's without 750,000 DACA cases. And if the Republicans want more money for their deportation machine, they have to go through congress, where the Democrats won't let them have any more money for their wall or deportations without at least some relief for DREAMers. Things are far from over, even now. It's just not as simple as people think to just suddenly decide to deport all DACA people.

I know that one of the main concerns is the EAD. I am one of those people who will for sure lose my job if they take away the EAD. But even though I am worried, I still haven't given up all hope. Everyone will have to figure out what to do if they cancel the EAD's. I'm currently thinking of several things to try if they take mine away and I lose my job. After having a nice career at a comfy office for the last 3 years, it would suck to have to go back to menial labor. If I get desperate enough, I might just file a BS Asylum claim just to purposefully get myself referred to an immigration judge and score myself an EAD while my case is pending for years and years in immigration court. I AM NOT RECOMMENDING THAT ANYONE DO THAT! I'm just saying that if I get desperate enough, it's something I personally might consider. I have financial responsibilities that depend on my ability to legally work with my EAD, and if I get desperate enough and I have nothing else to lose, there are worse things than having an open case in immigration court.

What DACA people have to keep in mind is that the vast majority of us do not fall into the expedited removals category, we are not a priority for deportation, we have a right to due process, and we have a strong media presence at the moment. Things are far from over, we still have options and support so lets try and keep the negativism down a bit. Sorry for the rant, but all of the negative comments were starting to bum me out. Things look bad and people are scared, I know, I'm scared too, but giving in to fear doesn't help anyone at this point.

I love how everyone assumes everyone expires in 2 years, most of the people in discord, me included, expire in like 6-7 months.. so yeah theres that. I wish theyd give us bridge act at least 3 years to find a solution.. I'd even ask for a year but 6 months is not enough time for me.

From what I understand BRIDGE Act will be introduced right away if they get rid of DACA. So even if you expire soon, there is still hope. We shouldn't forget that everyone has a different expiration date. BRIDGE Act, or SAFE Act, or something attached to some enforcement bill would be great. Even if it's only three years, at least the three years would be uniform, which would be great I think because if everyone expires at the same time, then we all come out at once and the issue becomes that much more urgent. Right now some people in congress are like "well, take it away and we have two years to do something about it." But you are right, a lot of us don't have two years.

Bridge act is brilliant, because everyone expires at once. That would be a great starting point for republicans to fully legalize us in 3 years, right before they have to convince some hispanics to vote for them in the 2020 election.

I do think this is the best thing for us now. Its going to be difficult to pass a comprehensive bill. There will be lots of discussion that will take awhile. And a lot of democrats want all undocumented immigrants to be legalized, with a pathway to citizenship. That's a hard sell.

I think a waiver of the 10 year ban + work authorization + ability to travel will be good for most people. American citizens do not think it is fair that the undocumented get citizenship despite breaking the law. I get the feeling the dems want a pathway in order to get their votes in the future. They should put politics aside and focus on dealing with the issue. It will be good for the entire country.

Kelly seems to be a Kobach Jr. He also took issue with us serving in the military to expedite citizenship. Hey, who gives a fuck if you go out there and give your life for america. I don't think we are on target for deportation at all. There are 11 million undocumented people in this country, and they are not going to aim on Dreamers, it will be a huge mistake, it's going to look bad and Trump don't like bad press.

But then, I see no reason why they will keep DACA, unless something out of the ordinary happens to make them change their mind. And once DACA is gone and our EAD expires, life will suck, it's hard when you have to go backwards in life.

And the way things are now, congress has no incentive to pass any relief for Dreamers. Again, unless something bing happens to shake their priorities.

tbh its just not reasonable that there won't be no replacement for daca. it just doesnt make sense from a policy standpoint. we are already out of the shadows and it just not plausbile for them shove us back into uncertainty.


strong enforcement legislation w/ "legalization" is best option and what should happen. and i use legalization term loosely as it could mean bridge, safe acts or lpr.

My exact thoughts! I wouldn't see the point of ending it just to end it. We make up a small percent of undocumented ppl. I feel like they might be like fuck it, let's give them something to get this outta the way. I feel like we might be safe but it's gonna be harder than a mofo for our family and friends who are undocumented. When I say hard I meaning damn near impossible if not impossible to cash a check!

Politics does not make sense. Think of other issues, Republican politicians are narrow minded people who want to preserve the status quo and cater to their donors. Not all Republican voters but politians are the worst.

I have a plan A and a plan B and a plan C. I suggest everyone be on the cautious side.

As for the raids and waiting-for-you-at-home part:

"Kelly also said the agency doesn’t appear to have a particularly efficient way to track visitors who have overstayed their visas and suggested it may be appropriate to “send someone to their house or last known residence and ask them why they haven’t departed.”"

And as stated before in another thread, it's easier to pick up your run-off-the-mill undocumented immigrants than actual criminals, as they're not hiding. As much as I'm hoping for the best, it doesn't look too good right now
