Then the packet started circling Chicago in a mysterious holding pattern. From Sept. 17 to Sept. 19, it was “in transit to destination.” Then its tracking whereabouts disappeared until Oct. 4. Once again, it was ”on its way.”
On Oct. 6, a day too late, it was delivered. And the application, for a 24-year-old man who asked to be identified only as José because his legal status was uncertain, was rejected.

Its the lawyer's fault. Why would he rely on the USPS? Why didn't he send the package again through Express? Maybe he never checked the tracking until it was too late. Why would you think certifying the mail is the same as Priority Mail or Express Mail?

Moral of the story just pay for next day delivery. The benefits outweighs the cost. Though so far USPS has never messed for me, I think I used priority delivery with tracking and signature $6 dlls if I remember correctly, I didn't want to pay for $20 dlls for next day delivery. My big envelope was delivered in two days. Go figure.

Just sheer bad luck for that DACAer, I guess they mess up one time for every 200k pieces.

Moral of the story is hold the attorney responsible for checking *on time*(meaning its expected delivery date) and resending it with 2day delivery while the original app was tracked so that the applicant did not lose his/her opportunity.

Malpractice perhaps? At the very least submit a complaint to the ethics committee for not acting in her/his client's best interest. If I were a lawyer and I saw that my client's application didn't make it to USCIS when I thought it would I wouldn't wait for USPS to sort it out. I would reprint the application, call my client in ASAP to sign them and overnight it even if I had to pay for the overnight myself.

We're talking about somebody's livelihood and a lawyer's ethical and professional duty to protect their client at all legal costs...

EDIT: They submitted on 9/14 - even if they sent it regular mail it should have been there no later than 5-7 business days. 2 days is standard but for argument's sake let's say shit happens and it's still not there 2 weeks later. That's a major red flag. Abort mission. 2 weeks of wait time would have put them at 10/2 - just enough time to prepare and send it again.

Actually its not that bad. I send thousands of packages every week. They have only lost like 3 packages and there has been like 5 packages that were going in loop between distribution centers in like 12 years.

Ehh. I can see it being favorable for small businesses due to the costs.

San Diego USPS has always been reliable to me. Every delivery day I also get an email with all the mail scanned of what is going to be delivered to me to that day.

USPS is pretty good, the clerks at the front are pretty bad. What USCIS should do is a special exception for the people who were affected by this nonsense.

Maybe it should be expanded into a final renewal for everyone.

Can't recall a time I had an issue with USPS. Back in college, I used their service when the gf at the time and I were selling our junk on eBay to pay for tuition. No package was delayed or lost.

PayPal on the other hand...

Simple. If postmarked on or before Oct. 5th, accept the application.

Why? If the deadline to something is the 10th. It is up to the recipient to make sure it gets there on the 10th or before. Just because it was postmarked it doesn't mean it needs to be accepted.

If you want it your way, then the guidelines should change to be postmarked before this date.

That means they will contradict to what they posted. USCIS needs to change the requirement to no later postmarked than *date*. That I agree with but not that the USCIS just accepted anything postmarked after a date when there were rules.

Good news uscis is now accepting those who got rejected because of the mail was late, they announced that yesterday, so any one that send in there application before the deadline and got rejected can now send it back in
