“First, the Court may say nothing at all when new orders come out at 9:30 a.m. Tuesday. That could occur if the Justices have not yet made up their minds. It also might occur if the Court had voted last Friday against review, but some Justices wanted time to write dissents protesting that refusal. A denial of review would not be a real surprise, since the expedited procedure is so seldom used, and especially since the Administration did not seek to put everything on hold until the Justices could decide. A denial of review would result from a failure to get at least four Justices’ votes in favor.
Third, if nothing emerges on DACA at 9:30 a.m. Tuesday, that would not rule out something happening later in the day. If the Justices have not made up their minds, they could schedule a further look at the case at their next private conference, set for next Friday. If that happens, it should be disclosed Tuesday afternoon. This morning the Supreme Court released orders from the justices’ private conference last week. The court did not act on the federal government’s petition for review of a dispute over whether the Trump administration can terminate the program known as “Deferred Action for Childhood Arrivals,” which allows undocumented immigrants who came to the United States as children to apply for protection from deportation. In a relatively rare move, the government asked the Supreme Court to weigh in even before the U.S. Court of Appeals for the 9th Circuit has ruled on the Trump administration’s appeal of a January 9 ruling by a federal judge in California, who blocked the federal government from ending the DACA program. Many court watchers believed that if the justices planned to grant the government’s request and hear oral argument in the case this term, they would have done so last Friday, shortly after their conference, to jump-start what would be an expedited briefing schedule. The justices likely will consider the case again at their conference on Friday, February 23.

The question that has been bugging me is the following: What happens if they just feel like not renewing? They could keep the applications on hold as long as they want. Isn't that a possibility?

That's why it is naive to think that we have leverage/time on our side. Congress needs to act and act fast. I wouldn't hang my hat on this injunction or two more years of DACA. |

I don't know much about Paxton besides the lawsuit, but why didn't he attempt a lawsuit when Obama was in office? My memory is rusty in that aspect, I just remember DAPA being stopped.
