9th Circuit Schedules DACA Termination Case for May

https://www.numbersusa.com/news/9th-...ation-case-may

The 9th Circuit Court of Appeals accepted the Administration’s request for an expedited hearing on its appeal of a lower court ruling concerning the termination of DACA. A three-judge panel of the court will hear arguments in May.

Please God save us.

Hello,

It has been published 12 hours ago, and I also wonder now why only that site published this news.
Does it sometime publish the false news?

Hopefully it gets terminated (though they’re left-leaning judges), that is the only way you will get congress to act. Trump wants the wall and I can see him caving.

Hopefully it doesn’t get terminated because I have no faith in any of those motherfuckers.

Shiit.

I renewed in September 2017 but with this news I'm sending in another renewal ASAP.

Well if it is terminated, there will once again be another opportunity to pass something temporary or permanently before the election. The next budget deadline will be October 2, 2018

I doubt it will be terminated; SCOTUS will review it.

No matter what is the outcome, this should go to SCOTUS

Both sides should appeal unfavorable ruling

If 9th circuit is friendly to us, why would they accept to fast track this case?

I actually believe the total opposite. There will probably be no opportunity to pass anything as long as this administration is in. These are my reasons for this:

1. Democrats will balk at anything this administration proposes that does not align with a progressive value

2. There is no reason for Democrats to tackle major legislation if there could be a possibl change in majority just a month away....why mess with that? They will have the belief they can get a better deal after elections

3. The Democrats message is to resonate with frustration. The center of that frustration is the current President, and the message is "Elect us to be a check and balance on the current administration!"

4. Democrats may not say it...but they will believe any new majority they are given they have an impetus to check the President's power....and if possible violations have accrued by their stands...even impeachment proceedings.

Bottom line, we are looking at another divided government...where partisanship is king. Major legislation technically cannot survive that unless there is reasonable balance.

So you’re predicting if this thing is on the verge of being terminated by the Supreme Court, not even a temporary fix will be able to pass next year?

It was at SCOTUS’ request they expedite the hearing. That doesn’t mean they will come to a conclusion in May

"To the extent the motion seeks to expedite briefing, it is granted. The consolidated first and second briefs on cross-appeal have been filed. The consolidated third brief on cross-appeal is now due April 3, 2018. The optional consolidated fourth brief on cross-appeal is now due within 14 days after the filing
of the third brief on cross-appeal.

To the extent that the motion seeks expedited calendaring, it is granted. The Clerk shall calendar these cases before a randomly selected panel of all Ninth Circuit Judges among all possible sittings in May 2018. See 9th Cir. Gen. Ord. 3.3(g), (h).

To the extent that the motion seeks an expedited ruling, it is denied without prejudice to renewal before the panel that will be assigned to decide the merits of these cases."

?????!!!

Democrats (general statement) = Democratic leadership, ie. Schumer, Pelosi, Hoyer??

They are NOT progressives and have shown that they will not stand their ground and be the advocate for voiceless undocumented immigrants.

It is highly disappointing to see fellow Dreamers or immigrants peddle electoral (voting) campaigns as immigration relief discussions.

Have you seen the budget that will be in the Omnibus?

Trump WILL get 1.6 billion for the Wall! DHS asked to double the number of detainees to deport and I have yet to see Schumer, Durbin, Pelosi, or Hoyer object to it.

Right now, the Hispanic Caucus along the Progressive caucus sent a letter to 'leadership' to oppose this funding.

Rep. Lujan Grisham is pushing to include the Dream Act relief in this vote while Pelosi undermines her by telling the press that she won't presdure for it.

WTF?

Trump fired Deputy FBI director McCabe and that is taking over the air waves. What a shitshow and disservice to taxpayers; citizens and immigrants alike.

Not sure what you mean? The 9th circuit judges aren't going to be the ones hearing the case? I'm confused by this statement. We're pretty much banking on the 9th circuit judges being liberal and to agree with the lower court's ruling. If not, the lower court's injunction will be overturned and they will not be accepting renewals anymore.

It will go to the supreme court but no new renewals will be accepted until the supreme court rules in our favor, if they run in our favor at all.

They agreed to hear the case sooner than expected.

They did not agree to rule on it sooner than expected.

That does not make it a fact that they will rule that the President cannot terminate a discretionary program or that it has to stay when it is not law or policy. It's a DHS memo like the one used for DAPA. But I am not an attorney.

I don't see how this can be won based
on current law which is why this lawsuit is a waste of time that should be used instead by Congress to pass laws to protect all Dreamers. Wasting taxpayers' money and wasting donations used by the organizations involved.

Like others had said, it does not hurt to try. If you do get approved, I think the approval overlaps with the current relief period, meaning you might get a few more months of protection.

This shit is so fucked up. I hope Trump comes to the middle on a narrow deal. fuck this shit.

It was sent to leadership on BOTH sides of the isle. I hope they withhold their votes do not allow this to pass without relief for childhood arrivals.

Fingers crossed.

Sadly, I am basing more hope on Trump coming to the middle on a deal than I am hoping that Democrats use leverage.

Best case scenario. Trump boxes in democrats and forces a wall for dreamers deal. And then goes for a CIR in exchange of chain migration and more stuff.

Because democrats nor republicans give a shit about us. The only way something is gonna get done for us is if someone gets something out of "helping" us. And that someone is donald trump with his racists friends and his stupid wall.. so yeah keep waiting for democrats our saviours since we are the inspiration and pride of america.
