Very crucial for DACA as he will be the deciding factor and tie breaker of possibly ending DACA for good.

Ending DACA at this point just hurts them back . Many of us are already employed as professionals and are attending universities. So why end it???

They just want to follow the law, even when sense dictates that DACA is legal and implemented properly.

We should get eDACA and DAPA out of this.

No, I was making grand statements. However it would certainly be grand if we did get eDACA and DAPA, but odds are we wont. Odds arent even in our favor, but shit, when have they ever been amirite?

I don’t care about DAPA. The reason of why there was a halt because of DAPA. That was not an extension of DACA.

It does because there were not three deferred action programs; there was Dapa and Daca. Obama modified Daca, which any president can do as long as the program exists since it's discretionary. Extending it covers more Dreamers, but it does not create a new program.

DACA is a policy. Policy is not law. Policy is guidance. These lawsuits only serve to get useless politicians off the hook and waste millions and millions of taxpayer funds.

Get Dream Act in the budget in September.

The government full of Ivy league educated attorneys ' forgot ' to publish a rule and comment period for DAPA?

My two cents: it's clear Obama did this to get activists off his back and then have the matter conveniently get taken off his plate with litigation.

I really forgot exactly why dapa and eDACA were stopped by that judge but the main issue was something about IDs. And that held everything back

DACA didnt follow APA, it was created by an executive order (a memo from DHS secretory). it didnt have notice and comment period.

At this point, would a blue wave even save us? They also have Nunes on Audio saying they want to confirm this guy to then move into impeaching Rosenstein, then you know who comes next.

I've been trying to not even think about it, but my mind knows the date is coming and its such a pain..

P.S. Still can't believe Obama got fucked a Judge for 6 fucking years, only fucking Democrats let people do that shit to them.

Obama announced DACA on June 15th. The first applications were reviewed on August 15th. Those 60 days were the notice and comment period. And if it was created by an executive order, tell me the number of this executive order.

yeah I don't know where people keep getting that DACA was an EO. It wasn't it was a memo given by USCIS and Obama signed it. This was all USCIS doing NOT Obamas so why the held would this APA hold ground for DACA?

so you dont know how APA, notice and comment period works?
for a rule to be implemented first agency responsible creates the rule, then submit it for OMB review, they review it and send it back to agency. then agency publish that rule in Federal register and ask public to comment on it generally a 30-60 day period. after comment periods they evaluate all comments and adjust or not adjust the rule. after that they again send it to OMB for review. if OMB OK the rule, they publish it with an implementation date. DACA didnt follow it.
DAPA/eDACA was also announced in Nov 2014 with an implementation date from March 2015. it failed APA test and was ruled deficient.

STEM OPT was implemented through a memo by Bush government and was stuck down by the DC court in 2016 because of APA deficiency but he suspended his order to allow DHS to implement it by APA which was quickly done by Obama DHS.

I cant understand why Obama didnt do same thing for DACA/eDACA?
