Possible EO to kill DACA soon?

White House teases executive orders on China, immigration and prescription drugs

https://www.politico.com/news/2020/0...gration-349717

Quote:

White House chief of staff Mark Meadows said Monday that President Donald Trump plans to sign a handful of executive orders this week as the president looks to right his reelection campaign after a brutal June that saw his poll numbers plummet amid a coronavirus resurgence and racial unrest.

In an interview on “Fox & Friends,” Meadows gave few details about the coming orders except that they will pertain to China, bringing manufacturing jobs back from overseas, immigration and prescription drug prices. The chief of staff cast the orders as the White House pushing forward with some of its top priorities after stalling in Congress.

“We're going to get them done when Congress couldn't get them done,” Meadows, a former North Carolina congressman, said, adding that the orders will demonstrate “business that actually goes forward from the Oval Office when Congress doesn't act.”

But the timing of the new orders comes after a particularly bruising month for the White House.

As states across the country began to reopen amid the coronavirus pandemic, more than half the country began to see increasing infection rates in recent weeks, leading more than a dozen states to halt or roll back their reopening process as the country saw numerous record-breaking daily cases reported. The White House, meanwhile, has given mixed messages about the outbreak as it has sought to play down the severity of the spikes.

The pandemic flareups unfolded against a backdrop of sustained racial unrest following the police killing of George Floyd in late May, with Trump stoking the culture wars by disparaging protesters and leaning into “law and order,” defending military bases named after Confederates, and vowing to protect statues protesters have attempted to topple.

Also last month, the president’s first campaign rally since the pandemic began drew a paltry turnout while poll after poll showed Trump trailing former Vice President Joe Biden, in some cases by an increasing margin.

Meadows did not miss the opportunity to contrast Trump’s coming executive orders with Biden’s lengthy political record, deploying an attack the campaign has used often.

“The interesting thing is this president will do more in the next four weeks than Joe Biden and his team did in the last 40 years,” he claimed. “So you just need to stay tuned.”

Can’t rule it out but it wouldn’t be wise given that it’s close to November. It’s a double edge sword imo.

We're talking about a guy who thinks doubling down on racism is gonna give him more votes. So being wise doesn't have anything to do with this.

If that happens a myriad of lawsuits will put the decision in the court system which would take about a year to be dealt with.

Yeah its happening

Trump expected to refile paperwork to end DACA this week

President Trump is expected to refile paperwork this week to rescind the Deferred Action for Childhood Arrivals (DACA) program that offers protections for thousands of young immigrants, according to multiple people familiar with the planning.

Trump was initially expected to move to re-rescind the Obama era program last week, but it was pushed back, according to one source. The exact timing remains in flux, but Trump is now expected to file the paperwork this week.

White House chief of staff Mark Meadows hinted in an interview with Fox News earlier Monday that the president was readying executive action on immigration issues, though he did not offer specifics.

The decision to refile on DACA was widely expected after the Supreme Court ruled last month that the administration failed to give an adequate justification for terminating the program as required by federal law. But the court made clear Trump had the authority to rescind the program, essentially forcing the president to try again or risk the appearance of backing down.

"We have to refile,” Trump told Fox News days after the ruling. "And everything’s going to work out for DACA and the young people, who aren’t so young, if you want to know the truth."

The new filing would likely be challenged again in court. It's unclear if the rescission would go into effect prior to Election Day, but Trump's renewed focus on ending the program will likely make it a key election issue and could put the spotlight on Congress' inability to reach an immigration deal.

The Trump administration in 2017 rescinded DACA, which shields young undocumented immigrants who were brought to the U.S. as children from deportation. The move was a central feature of the president’s initial efforts to restrict immigration upon taking office.

Polls show that there is broad bipartisan support for protecting Dreamers, but the president's allies who favor restricting legal and illegal immigration have argued he has little choice but to follow through on ending the program.

“Overall absurdity of the ruling aside, the Supreme Court provided a clear procedural roadmap of how to rescind the program. We expect the administration to do so in the coming weeks,” said RJ Hauman, head of government relations at the Federation for American Immigration Reform.

The president has in recent weeks turned to immigration to appeal to his core supporters as he scuffles in the polls. He signed an executive order suspending certain work visas for the rest of the year, a decision cheered by allies who viewed it as protecting American workers amid an economic downturn.

Trump visited the border wall in Arizona late last month to highlight construction on his trademark promise of his 2016 campaign.

Probabaly just posturing for the election. We'll be alright if he acts since it may take a while for it to be executed, facing possible roadblocks and challenges from legal action from those that do not want our ability to work and to stay in the US being taken from us. We may even have Biden in by that time too.

Remember to tell your USC friends and family to register to vote and kick President Miller and first lady Donald out this November.

This will be challenged in court again. DACA will be fine until next year I believe. If Trump wins, I think DACA is dead. Not sure if a solution would pass, but does anyone actually believe it would? We've been down this road for almost 20 years and it never happens.

Lmao yes they will spin it and say their hero Trump is just doing this to make us all legal and put pressure on Congress and then ending with the usual rhetoric of I will vote Republican for life after I am legalized  SMH

Just leave us alone, Trump. Republicans are the biggest hypocrites, they keep saying executive orders by the President are an overreach of power but Trump keeps issuing executive orders one after the other.

Even if the rescinding doesn't happen, should we still get our renewal paperwork in before the furlough? Cuz we don't know how long the furlough is going to last. Unless Biden wins and bails out the USCIS.

Good he is doing this, hopefully it all moves quick and forces congress into fixing us once and for all.

Willing to pay thousands for whatever fines we get to pay and getting ready to vote republican for the rest of my life. And if it fails its going to be the democrat scum fault flat out. Compromise needs to be done.

Nothing is happening this year.

Chances of Trump getting reelected are abysmal. Even if Trump gets re-elected, I doubt Democrats and all the proimmigrant orgs will agree to anything. It will be Trump's last term.

Democrats offered Trump $25 billion for the wall in exchange for DACA. He agreed and then turned it down. These are facts. I don't understand your logic, we are in this mess because of the republican party.

Next time before opening your mouth remember this quote from a real patriot:

Yep, Trumpanzee himself was offered a fair deal, Dream Act for 25B for the wall. He said no because Miller thinks that he could get his 4 pillars for fucking Bridge Act.

It's funny you would vote republican for life and blame democrats for not compromising. I never seen a more disgusting party than the republican party. Maybe if it hadn't been immigration I would of been close to a republican but now I would never vote republican. Can't wait to see the two party system collapse.

They have built THREE NEW MILES of fencing and repaired 90 miles of the existing fence. It's truly laughable.

Re: Possible EO to kill DACA soon?

I could be wrong but I don't think that the supreme court needs to wait or can be challenged on this specific topic anymore, the supreme court has already decided that Trump has the right to end DACA but needs to give a reason why. What is not clear to me is how soon would the court take to review Trump's re-filing (explaining why he is ending DACA). So two possible scenarios IMO:

Scenario 1

Trumps re-files and the Supreme court kills DACA before the 2020 election. Trumps makes a deal with the Dems to fix DACA and a) The Dems offer nothing less than the full dream act and Trumps take it, yay!, b) Trump offers some shitty deal that covers almost no one and the Dems take it, almost no chance this will happen IMO specially knowing that the Dems could possibly do very well in November and c) Trump and the Dems fight and blame each other but nothing happens (most likely scenario IMO)

Scenario 2

Trumps re-files and the Supreme court kills DACA after the 2020 election and a) The Dems win bigly in November and pass the dream act (or a version of it) with the help of some republicans senators b) The Dems win in November but they can't pass anything because they don't have enough support of republican senators to get 60 votes or c) Trump wins again in November and since he is not running again he does nothing for DACA.

Analysis,

I believe Trumps is hoping for Scenario 1a or 1b, his polls are in the trash and he only cares about winning, if he offers DACA for his Wall and gets it done then he would gain support from the left and the right. Trump has said in the past that one of the reasons Obama won his re-election is because he "gave a gift" (DACA) to the Latino community just before the election.

Option C: Biden can just withdraw the repeal. If DACA is rescinded properly via substantive regulation depending on when the end of the 60 day is: before January 20th - put another substantial regulation out withdrawing the repeal of DACA, after January 20th - just cancel it. EO would just get tangled in another lawsuit and become moot come January 20th, would be easy argument too: Trump was told to do it this way and decided to do something else, give us an injunction because this tard can't follow simple instructions.

Also, Trump's wrong in one thing. Obama "gave a gift" because democrat aligned latino and other immigrant groups were threatening to sit out the election (not that they would in a million years vote for Romney). There isn't a fucking thing he can possibly to make this group consider voting for him or sitting it out. Even clean fucking CIR wouldn't wipe away the last 4 years of nothing but shit.

He should but he's still gonna be unemployed come January 20th. He's probably throwing around hamberders around the oval office trying to rile up the local nazis while forgetting that what pushed him over the finish line was a bunch of white moderates that wanted change without really caring what change was, 4 years later they know that the Trump version of change was shit, unemployment, and a pandemic.

Trump will never let DACA slide. Its here to stay forever. The "refiling DACA papers" is meant to keep the base happy. DACA is the ultimate election vote generator, especially for Democrats. DACA recipients are quite possibly the safest group of undocumented immigrants in this country, very politically precious.
