My DACA renewal expires this Sunday and the tech company I work for has already said I can’t work past that date 😔. USCIS is working on my case and I already emailed my congressman for help. Is there anything else I can do?

Is contacting Ombudsman overkill at this time (since I already asked congressman for help)?

Unfortunately, the same thing happened to me but my company was able to put me on a leave of absence until I was able to get my EAD. I told them that I was in process but there were delays.

Thanks all, people are telling me we have a 90 day extension which is mentioned on the receipt notice. Is this correct? Seems wrong to me.

have you tried actually calling uscis for an expedite? The congressional inquiry is probably going to be the fastest. I would follow up with the congressional aide through the phone so that they can act on it faster.

Thank you, the aide mentioned she will reach out this week. Praying for myself and I’ve also just found out I’m expecting my first child in November. Timing couldn’t be worse. Thanks all

Yes. I applied about a year before my expiration and it was accepted.

That doesn’t apply to DACA based EADs. Someone correct me if I’m wrong, but that was my understanding.

You are correct. The auto extension does NOT apply to DACA c33. See link below.

The fact that OP won’t say when they submitted the renewal tells me it probably was at the last min lol.

Anyways you should receive an extension on your receipt.

I applied in earlyFebruary of this year. We are not eligible for the 180 day extension. C33 is ineligible.

This is the exact reason why I always apply super early. I always apply 1 year ahead. Better to be safe than sorry.

A few years ago in 2016 when a lot of dacas didn’t get renewed on time my daca expired and I got fired from the company. They asked their legal team and they I had to be fired because I couldn’t be on the books like that. However, soon after I got approved and reapplied for my job.

Did you receive the receipt notices?
Did you try to email them direct from your USCIS Account?
Did you call USCIS?
Did you get a new bio letter?
If 105 days ha passed, the estimated maximum time for processing your EAD, you are
Required to call them.
Did you reach out again to your senator/local congressman?

If not, you need to do that.

This is just a case of OP submitting their renewal way too late, 2 months before expiration.

Oh yeah I cried often in the weeks leading up to it. It wasn’t fair but it had to happen.

Yeah they paid my PTO hours I was 3 months new to the job and doing great at the time. Those pto hours plus my saving really helped me to stage a comeback and I also applied to a part time min wage job while I was on boarding to return.
