Back from traveling with AP through DACA

Hi everyone I am new to this forum. I just wanted to write to share my experience through Advance parole. I applied for DACA on August 16, received my card by September and SSN/Drivers license within a two weeks of getting it. I applied for AP on October 25 and received my approval by November 24th. I traveled right away since they only gave me till December 22nd. Came back December 14th with no issues. I knew it was a huge risk but I was willing to take it. My grandmother is ill and her health is quickly deterioration. I am EWI and married to a US citizen.

How did you get ap so early if the rules for AP for DACA are not out yet?

Re: Back from traveling with AP through DACA

Holy shit is this serious? How were you able to travel? Uscis recently stated a new i130 form is in the works, and the form page advices to avoid applying until then

Re: Back from traveling with AP through DACA

My sister in law is a paralegal she helped me with all the paper work all I had to submit was the application the fee and a cover letter. I also sent Documents sent to me by my family members from her Dr. My approval letter stated I received AP for humanitarian reasons.

And for the record you're no longer ewi and there's a possibility of adjusting your status through your spouse.

FlyinAgainstTheWind 12-21-2012 02:31 AM

Re: Back from traveling with AP through DACA

^Someone in the AP thread was saying this wasn't necessarily true for EWI's but I wonder if her case will be different since she did not get AP through the new I-130 form.

You actually might not need AP if the new rule for waiver of inadmissibility is published in I'm guessing early January if you are married to a USC or have an immediate usc relative.

We went in bus and came through laredo. I was so scared I thought I was going to be sick . There are agents waiting for you when you get off the bus and they ask to see your documentation. I showed them the AP form along with the approval letter from Deferred action and my passport but noone was interested in my passport just teh letter that needed to be stamped. They told me to be sure and get it stamped. Had to go to another line were they check your documents again and he actually called someone over to ask about the form, once the other guy got there he told him to just admit me and he escorted me over to a small office and hand the papers to another agent who told me to have a seat. It about 15 minutes before they callled me in. Once they took me in he took my finger prints and was asking me where I live and if I worked, it didn't feel like I was being interrogated more like a conversation. After a few minutes I saw my picture pop up on the screen with some info. He said OK you can go outside while I get this stamped. I went outside and he came out after about 10 minutes, handed me the AP paper along with a small form I-94 and he said this was my ID while in the US and that if I was questioned to show that as my ID

You can definitely adjust status inside the United States currently then. The I-94 document is what they ask for during the Adjustment interview and I am sure this will be the most popular thread now, lol.Prepare for a lot of questions about the process!

Sorry about the circumstances concerning why you had to travel, btw!

Mmmm. No there are some people who've joined the forum that didn't know what EAD was..........However what he describes is correct, the CBP officers issue an I-94 at the port of entry to indicate legal entry and presence in the US

True but let OP answer my question first because what she took with her doesn't make sense if you received DACA. The I-94 story doesn't make sense.

Thanks! I'm so glad I went my grandma had a small stroke a couple of days of me being there and I was the one who ended up going with her and my grandpa I was terrified at the way they treat people there. It is so different and scary! She was seizing and they wouldn't even take her in until they got her ID from my grandpa. Luckily she is ok but she still does not recognize some of my cousins. It wasn't as bad as they make it seem I was 8 when I left and I still remember most of it and it look the same except with a lot more cars!

You got to travel in a humanitarian means and see your relative.

Which remains me, one way to prove your point is, to post pictures of your I-94 stamp (do not alter any of it).

oh you mean my work permit card? Yeah I have that but I did not present it. My sister in law told me to only show my approval letter adn teh AP form with my mexico passport and to only show additional paperwork if I was asked for it. Believe me I had a binder full of documentation including the complete copy of my DACA application and my AP application.

"ap paper"

i thought ap was a card too?

FlyinAgainstTheWind 12-21-2012 03:16 AM

Re: Back from traveling with AP through DACA

She is a troll or a catfish. lol. She googled EAD...It makes no sense not to present it because AP is based on someone having some sort of lawful status in the US. Her mexican passport alone with no visa with an AP document would not be enough and neither would be a receipt or approval letter for DACA at a border crossing. The I-94 as an ID makes no sense because the EAD itself is an ID and includes all biometric information and picture. Trollinnn!! or Fashionfreaking!!!

No,AP doesn't always come in card form you may request it but considering the timeline AP was valid for the OP it wouldn't have made any sense for USCIS to issue a new card. Now if an individual was to try getting a multiple entry AP through a pending I-130 they just might change the EAD.

At the OP,might I suggest taking a pic of your I-94 absent any identifiable numbers and inclusive of the date and upload it here as proof to quell any issue of being a troll.

If anyone has questions I will answer them but I dont appreciate being called a troll or catfish or whatever theyre saying. I'm live in Texas if that helps anyone from there. well i dont see how I can do that without altering it lol I took the paper out to look at it its an I-797 notice of action and it has my name alien# date of birth adn address adn at the bottom it has my picture. The I-94 form its a small square with my name, date of birth and departure number adn it is stamped and the officer wrote in with pen the info it says AOS on it. Everything has my info on it my address date of birth and picture except for my deferred action approval letter which also says I797 notice of action at the top.

you can cover it with a paper when you scan it. We are just protecting ourselves and I hope you understand that. The last thing we want is for people to file things based on bad information. Plenty of people come in here pretending to be something they are not.

Well, look at this on the bright side, now you know what a "troll" and "EAD" means.. Of course if you in fact are a troll (Which I still retain some inquietude about it), you probably knew all this already.

But forget about that.. Back to the questioner.

Which center Processed your DACA application? Receipt Number?
Which center processed your AP application? Which was kinda fast, according to your previous statements.

Lol Im still unsure what a troll really means I feel as if I should feel offended though.

I sent both applications to the USCIS Dallas Lockbox in Lewisville, TX . I paid extra to have it send overnight both time, which seemed crazy to the post office person helping me since I live like 30 minutes away lol. I sent everything I had my school records copy of my high school diploma and associates degree I have a 2 yr old so I sent his birth certificate and the house deed which is in both my husbands and my name, our taxes, bank statements, marriage license even my insurance card! lol I received my biometrics appt. for september 8th it took no more than 10 minutes. I got approved my approval notice october 2nd but knew before since my husband would check online EVERYDAY lol I applied for Advance Parole on October 25th application I-131 recieved the Form november 24th but got approved november 21st!

I am going to sleep I will check back tomorrow if anyone has any questions I dont mind answering them but its 2am here and my son will be up in a couple of hours. I got to say I felt so excited to share the news (trying to do it since I got back but It wouldnt let me post anything and barely today I got an "activate email") now I dont feel excited at all it is sad that people are so afraid to accept good news but I understand I was too at first when deferred action came about I had gave up hope since they had talked about dream act since I was in high school but never actually past. I am glad we get to do so many things now I actually have a license!!!! and I went to my hometown (Monterrey) and got to see family member I havent seen in 18 years! Good luck to anyone doing AP!!

And @Flyinagainstthewind you did not make me feel welcomed in this forum at all. Seems to me like you already have all the answers since you're so quick to question anything I said but Im glad if I could help at least one person
