I did go out of the county briefly during those days and have documents to show evidence of the travel. My questions are: Do you guys think affidavits work well in these cases? I am planning to submit some. Also, do I really have to show proof of the brief departures before June 2007?

On USCIS's FAQs it says you can, as long as you get at least two. Good luck! I don't know if you have to or not (send proof of anything before 2007) just read carefully what the RFE asks of you and send what you can. Good luck!

HI everyone , I was freaking out yesterday because I had nothing to prove i was here from when i graduated until i started college. But My ex employer was able to call the bank and track copies of all the checks made out to me that I cashed. They need proof from june 2007 until september 2008. I have copies of checks that i cashed pretty every other month do you think they will be ok with that? Because sometimes he paid me cash. And he also wrote a letter saying that i worked there what i did and that i never left the country while working for him. I also got another sworn affidative from my US citizen aunt saying that she sees me every week and that i never left since i came . I also found a medical records for some months and a dentist record. Sooo is this enough????? or they need more? I m pretty confident this is enough, but i just want to see what you guys think? I m taking all my evidence to the lawyer tomorrow for mailing . But there is like 1 or 2 months where the only thing i have is the affidative..

DreamBigGirl, you should have at least two affidavits for your 1 or 2 month gaps and all your other evidence seems like it will be just fine.

I have 1 month gaps like 1 or 2. But my affidavits are really broad they don't specify the months , they specify the entire periods do you know what i mean? Well my lawyer said they needed something in between the dates they stated, so I achieved that. Just didn't find a million things because I was only 17 at that time...

there is this envelope thats enclosed. you should send it with that envelope. I noticed that your Receipt number (i.e. Lin xxxxxxx) is written inside. I believe it's so that they can scan it before any other regular applications and save it in your folder.

Re: *****RFE Thread <- (Request for Evidence)****

This was my personal experience with "gaps":

I was covered continuously through June 2009 because of my school transcripts, then I took a year and a half after graduation before I went to college. My college transcripts started Jan 2011 until present. When I got the RFE, I was sooo worried about covering all of the months between 2009 and 2010, but the only way to do that would have to be by sending in 18 months worth of bank statements that I didn't wanna wait for, because the bank said it would take 10 business days.

So what I did was send in my medical records. I had had a visit in January, one in May, then August and November. I also found a bill dated for December of that year, and sent it as my RFE as well. Although these 5 items did not prove I was here on every single month, I was still APPROVED after getting my RFE.

So, try to send as much as you can, but dont stress it so much. The officers will use common sense... or so I hope.

:)

I never got a return envelope from USCIS. All I got was the letter with two blue paper inside. One describing what my RFE was for and another that Im suppose to send back.

I packed all my evidence inside of a 9 x 12 envelope with the RFE letter on top. Then i stuck the evelope inside of a post office Express Mail envelope and sent it off.

Same. My lawyer got my RFE with no envelope, the the 2 blue papers asking for a copy of my passport. I put the copies behind the RFE papers inside of a fedex overnight slip and sent it off. like 14 hours later they updated my status that they had received my response so I don't think the return envelope is necessary.

You don't have to show evidence of the brief departures before June 2007 however u need to show evidence of any travel after that. If you don't have the travel documents (plane tickets, hotel stay, exit entry stamps) you can have 2 people write affidavits for each departure and also yourself write an overall affidavit to explain your travels. Remember these two people need to have direct complete and consistent knowledge of the travel. The affidavit needs to be sworn and signed before a notary and witness. In case that the affidavit is from a foreign country and in different language, simply have it translated and certified here in the U.S......be prepared to spend!!!!!!!!!!

I have the same case like you and I sent two affidavits for each of my entries plus some travel documents. My case just got routed to Nebraska but I will keep you posted on how it goes.

Re: *****RFE Thread <- (Request for Evidence)****

Hello dreamers, i got my request of evidence yesterday.
Identity and graduate from school.
I sent them a copy of my passport, and i sent them back my transcripts but this time i sent them a letter to them explaining and giving more details about my transcript, i believe this is their mistake.. I dont know why the officer requested my diploma if im still in high school as of august 15, (enrolled on august 6), it states clearly on my transcript that im in adult school right now and that im in process of getting my diploma. It shows the date i enrolled 08/06/2012. And it shows i started school on august 15, i sent my application on august 17, and it might not be the best letter ever but here it is what i said on my letter:

Hello, i'm ....... ......, the applicant for this case, im writing this letter to the ucsis offficer dealing with my case. On october 18, 2012, i received the request for evidence letter in the mail, requesting a copy of any photo identification. Here's a copy of my passport. The second type of evidence was "graduated from school". I believe there's a misunderstanding on my transcripts as i have not graduated from high school and im currently in the process of getting my high school diploma. I have less than . (--) credits left to obtain mi dploma and i should be getting it early next year. My school requires one or two credits per week, and my teacher says i should be graduating in may. I attended ......... High school, from 2007 to 2010 as it shows on this transcript. I had to start attending ....... School when i turned 18 years old. I've been attending that school from 2010- to present. I've read the guidelines from uscis and it states that as long as im currently in school, i should be able to qualify for this program. Thank you for your time to read this letter. My name and then dated.....

What do you guys think? I even highlighted the years from each school, and i highlighted how many credits left i need as of the highlighted date on the copies of my transcripts... I also sent them two copies in color of my passport. Put the notice on top as requested, then my letter, then my passport, then two official transcripts with signatures and stamps from school.

No. Only sworn statements like Affidavits. Somepeople have even sent affidavits without getting it notarize.

I will be sending some evidence for purpose of travel (funerals) for some of the exits but I don't really remember ALL the exits I made out of the country (all brief) and they are not telling me either. What do you think? Have you consulted a lawyer regarding this?

- i-94 overstayed (got here in dec 2002 in 15 years old
- high school diploma
- highschool transcript (2003 - 2006)

- bank letter saying that i opened the account in 2007 until present time and its is active
- bank statements and comcast bills to prove that i was here in july 15, 2012

rfe notice date: Saw it online at 10/15 still waiting for the letter
rfe reason: Cont' resid for the years of 2007 to 2010
rfe response: Bank statments for each month since 2007, paytubs for each month since 2007, letters, marry certificate from 2009, opened company receipt in 2007 and renewed in 2009, rental contract in 2007-2008. It will be like 150 pages package of evidence. I made a summary page and place in the front of every year to be easy for them to find the dates on the documents.

Rfe delivered: Not yet

it was pretty much it! It was a really short application, 10 pages of evidences and 10 pages of immigration papper work. They probably going to ask to prove more evidences of stayed here without leave the country or they are asking for more identification which now i have my renewed passport. Its all good i have everything for every single month since 2007 until now. I hope they dont ask for 2002-2006 because the only thing i have is the high school paper work which i think is more than enough. Ill keep it update as soon i receive the letter.

RFE letter came in in the mail today and it states that I didn't show any evidence for the year 2012, I feel like such dumba#$. Oh well it’s not going too be too hard to fix this just going to send my bank and credit card statements, also my pay check stubs. Printers don’t fail me now. Hope everyone else is doing fine with their RFE.

On a side note if you go to your bank to get your statement printed out try and go to some one of an ethnicity other than white, so they can feel sympathetic towards your cause and won’t charge you the printing fee, whatever it may be. For me it was like 6 bucks a month, so for 12 month that would come out to 72 bucks.

basically u dont send that small envolope because obviously if u gathering too much evidences ofcourse is not going to fit in that little envelope, u just write the address from that envelope on a big priority or certified mail at ur local post office with the barcode blue sheet on top ur evidences so they can scan it and automatically recognize it.
