Worried about denial over forgetting to specify an arrest RFE
This is my third time renewing DACA, I had an arrest for petit larceny in NY, a class A misdemeanor, the charge was reduced to disorderly conduct and I was not convicted of a crime. I didn't originally submit anything thinking that since I didn't get convicted nothing would come up. I received an RFE for my arrest coming up on the background check. I sent in a court disposition from the courthouse showing the disorderly conduct. What are the chances that I will get denied DACA and how long should I expect to wait? The application is at the Nebraska center. Thank you.

you should be fine after u send in your RFE.

I posted the same question yesterday on AVVO, an attorney responded this
"Even though you thought nothing would come up, the question is clear: Part 4, Question 1. Have you "EVER" been arrested for, charged with, OR convicted of a felony or misdemeanor. If you did not disclose the arrest, there is a big probability of having your application denied." I sent in the disposition already, it was received 7/9 |

I'm pretty worried since I only sent in a certificate of disposition which shows the reduced charge, but I will keep you posted. Thanks.
