AOS - My mother

Hi Fam,

My mother got married in Feb 2021. Her now husband is scheduled for his oath ceremony end of May. He had GC for a decade but didn't bother to get his citizenship until he met my mom. He lives in Texas and my mom is FL. He will be moving to FL in a few months once his apartment lease in up in August but they are trying to get file before he moves.

Questions:

1) Will it be a red flag for him to sponsor since he just got his USC?

2) The fact that they don't live together YET - red flag?

3) Whats the income requirement to sponsor?

FYI - This is a legit marriage lol - Just figured i'd clarify.

How long have they known each other?
You must have enough evidence this is a real relationship

1. Nope.
2. Yellow flag. Married couples are expected to live together but if you can explain your circumstances it'll be fine (e.g. you both have good paying jobs in different places and lived apart while you both are job hunting at the other place).
3. 150% of the current poverty line which for a family of 2 is $21,775/yr.

Thank you! Super helpful!

On #2 - During his USC interview, they asked him about my mom and made him call her to confirm her name and address. They asked why they don't live together and he said that he was waiting on his lease to be up in December.

Did they get approved then?

yeah, her husband got approved for USC. Had his oath ceremony yesterday.

But they couldn't deny him citizenship based on his recent marriage... I suspect they will interview the crap out of him solely based on timing.

Alright, rejoice man! Your step Dad survived the hardest part. Your Mom should be really happy by now.
