Napolitano: Deferred Action Applications Will Be Available on August 15

Quote:

With regards to deferred action, Napolitano said that applications will be available on August 15 and added in her testimony that:

Individuals must also complete a biographic and biometric background check and not currently in removal proceedings or subject to a final order, must be 15 years or older to be considered for deferred action. Only those individuals who can prove through verifiable documentation that they meet these criteria will be considered for deferred action under this initiative. Individuals will not be eligible if they are not currently in the United States or cannot prove that they have continuously resided within the United States for at least five years.

Napolitano reiterated that the program will not cost American taxpayers because there will be a fee for the process (in addition to the $380 for work authorization and $80 for biometrics). It is important to note that DHS has not yet decided the cost of the application.

Looks like we're getting the information we've been dying to hear in terms of timelines and when things will be available.

Get your documents ready, people. Remember the fee that will be associated with this.

Yes. Individuals subject to final orders of removal will be able to submit an affirmative application to USCIS regardless of whether they have reached the age of 15. This process is not yet in effect, and no applications for deferred action should be submitted to USCIS at this time. If your client meets the eligibility criteria and is in danger of imminent removal, you should immediately contact the Law Enforcement Support Center hotline at 1-855-448-6903 (24 hours/day, 7 days/week) or the ICE Office of the Public Advocate at 1-888-351-4024 (9:00 am – 5:00 pm, Monday-Friday) or by e-mail at [email protected].

I have a final order, and I'm hearing yes from one source and no from another. Am I missing something?

I wouldn't worry. This probably means you will have to wait maybe a little longer. But who knows, you will be able to apply in time after all because as you point out, we have been hearing those with final orders are eligible likewise. In fact, you should be first in line.

If you meet the requirements you should apply with a lawyer if you have final order.
