Immigration attorney: The nine Dreamers pushed it too far
I don't know the specifics of each individual Dreamer's case but still do believe Leopold might be right concerning meeting the specific guidelines of 'Humanitarian Parole' and 'Asylum'.There is also the issue on if the government might consider this to be felony re-entry.

Hmmm, I agree with both; however, I agree mostly with Abdollahi that a 'prominent' attorney, in a position of authority on immigration law given his 'credentials' - and I think AILA is just a bureaucratic self-congratulatory group- giving national interviews that plant doubt on the actions of the group is wrong.
Remember when all immigration lawyers were issuing panic warnings against turning oneself to immigration authorities and voicing doubt about deferred action and prosecutorial discretion? The DREAM act movement moved deferred action to the forefront of deportation defense and the clients who requested deferred action or a stay of removal against the doubts of their attorneys, ended up saving themselves by coming forward and being authentic about their rootedness in this country (myself included, though I don't have an EAD). And I don't think an individual rooted in this country trying to make his or her way back to their HOME and families hurts the CIR movement. As if Lamar Smith, Peter and Steve King, Sen.Cornyn, etc, need an excuse to disapprove of a legalization program. Please. If it's not the nine activists, it will be the temperature dropped two degrees or Starbuck stopped offering their favorite drink, or fill-in-the-blank arbitrary and idiotic reason that no logical person would state. I discussed this with issue with my boyfriend, my sisters, friends and even some of my doctors, and they all said they'd do the same thing for their homes and families. I'm sorry, Mr. Leopold, your argument falls on deaf ears. |

Did John Lennon push it too far with deferred action? He had a drug conviction, I think. These are still individual cases with individual circumstances and just because those involved have public figures, we don't know all the details of their stories. Even their attoneys might not know every little thing or circumstance that when pieced together over the narrative and timeline would make their cases compelling. The activists have never been in deportation proceedings before, right? Except for the one woman who had been deported seven years ago and re-entered with the group. So, the government doesn't have a case file for them that would be as detailed and comprehensive as that of an individual with a case in proceedings and appeal. I don't think these will be the equivalent of class-action cases but the unknown and the possible is what's at stake here. |

See, youre thinking it from a emotional sentimental perspective. In that case you are right but unfortunately the people who have the power to pass a CIR are too racist and too closed minder to see through it are going to use this an example why we don't need a CIR and how we just need to secure our borders first.

Re: Immigration attorney: The nine Dreamers pushed it too far
I have a lot of empathy and compassion for people in unfortunate circumstances - one cannot survive working in healthcare without those instincts.
However...compassion and reason aren't mutually exclusive. Justice (the current immigration laws) determines that these individuals be returned to their countries of origin. Compassion dictates that some exceptions (discretion) be made. How can this be done? By revising immigration law - and from the revised law perspective it will seem unjust to deport them back. There is nothing that makes it impossible to revise ill-conceived, bad laws. Politicians have not a problem revising, rewriting and enacting new laws when the beneficiaries are CORPORATION$$$. It will only affect CIR negatively if we follow the sheep mentality and is the case when one person says something and everyone else sorts of nods and goes along 'yeah'...you know the drill. Edit: Politicians don't have a problem revising, rewriting and enacting new laws expediently for corporations. |
