Employment check + daca status
 
Hello guys,

Long story short,

I got all call from Human Resources, they asked whether the company needed to do anything for me in the future, I think she was getting at whether I needed to be sponsored, I said no, that DACA is a renewable. The other part of the discussion, was why are the Social Security Numbers not matching, they may be running credit checks which show up on my "non" issued social security number. The conversation ended with the company checking with their immigration attorney, she advised to hold off on giving two weeks at my current position until all of this settled.

As you all know this has been a very long road, from childhood, college grad, DACA Granted, etc, etc, I hope this opportunity does not slip away due to DACA Status.

My question is, can the company legally deny me employment due to my DACA Status ?

I feel a bit let down by all of this, even with DACA Status, still hitting snags, anyone have a similar experience, any thoughts would be helpful.

Legally they can not fire you due to daca, as long as you have proper papers they should not fire you, the only problem is that some companies do background checks and they might find if you had credit prior to daca a SSN that is not your, to fix that update all your CC and also contact all 3 credit agency's about your new SSN so they can update all info and remove what ever number that might be showing in your credit reports, hope this helps

Yeah this is not a problem with the company. I ran into this problem after receiving my SSN for the first time. I informed the company I was working for that my social was still new so they might run into problems when running a background check. You need to do the work and get your social out there go to the bank and update your bank account with your social and get a credit card so you'll have some history. The company is in there complete right to not hire you if you can't meet there requirements. So I would talk to them and explain the sistuation.

Thanks, I got the offer and accepted, now I have to pass these background checks. I just went to Wells Fargo to update my SSN, the rep was super nice, she called one of the credit bureaus to update the record. The bitch on the phone did not let her update but the banker said she will call their management tomorrow and keep me update. Thanks for your comments, I was thinking introvert about this, but I'll work on getting my SSN out there.

Thanks, I will contact all 3 Credit Bureaus and ask them to update my info, its going to be a nightmare to call all 3 and explain but have to do this.

There is a templet on mailing them your info in this forum, I'm remember because I used it but I'm not sure where in this forum

They can deny your employment if they think you will need sponsorship in the future. That is why they will talk to their attorney, learn about DACA and decide if DACA is acceptable as a non-sponsor situation.

I checked with my lawyer on how to answer this, he advised as follow in quote/unquote:
