House clears DHS bill for Obama

Quote:

Washington (CNN)The Department of Homeland Security won't run out of money anytime soon.

The House cleared legislation Tuesday that will keep the agency operating through the end of September after a standoff last week threatened to shutter the agency and furlough thousands of workers. The 257-167 vote sends the bill to President Barack Obama for his signature.

Republican House Speaker John Boehner, who rarely casts votes, backed the bill, along with his top lieutenants. A majority of House Republicans opposed the bill. Just 75 GOP lawmakers joined with 182 Democrats to push it across the finish line.

The legislation does nothing to rein in Obama's immigration executive orders -- a top priority of conservatives. That issue was a sticking point for weeks as Republicans tried to tie DHS funding to the repeal of the orders but the party couldn't overcome Democratic filibusters in the Senate.

The debate sparked plenty of drama on Capitol Hill over the past week. The House stayed in session late into the night on Friday after conservatives helped block a bill that would have kept DHS open for 3 weeks. Amid rumors of a potential coup, Speaker John Boehner pushed through a bill that kept the agency open until March 6 -- just enough time to work out today's deal.

Boehner told his members Tuesday morning that he had run out of options and the Senate couldn't pass a bill with immigration language attached.

He asked if anyone had any questions and not one member stood up or complained.

Enjoy.

The department has money. Great. So what's next in terms of the executive order. Still no news from Hanen.

Good to see the Republicans lose face nationally.

In all seriousness can Hanen really set his own time table in making a decision since he moved it from yesterday to today and still no decision has been made. Isnt he mandated to provide an answer even though in all likelihood he upholds the injunction regardless? This is unbelievably ridiculous.

I've been wondering the same thing.

The latest...(like 3 minutes ago), the states asked him not to issue a stay and apparently he doesn't have any timeline for an answer. In other words, he's trolling us.

A coalition of states suing to stop President Barack Obama's executive action on immigration asked a federal judge Tuesday not to lift a temporary hold on the directives.

The 26-state coalition, led by Texas, said in a 22-page court filing to U.S. District Judge Andrew Hanen in Brownsville, Texas, that "there is no emergency need to institute this sweeping new program."

"It is not in the public interest to allow (the U.S. government) to effect a breathtaking expansion of executive power, all before the courts have had a full opportunity to consider its legality," the states said in their motion.

Hanen issued a preliminary injunction on Feb. 16 that halted Obama's action, which could spare from deportation as many as 5 million people who are in the U.S. illegally. The states sought the injunction, arguing that Obama's executive action was unconstitutional.

The U.S. government on Feb. 23 asked Hanen to lift his injunction while it appeals his ruling to the 5th U.S. Circuit Court of Appeals in New Orleans.

Justice Department attorneys have said a stay of Hanen's ruling is needed "to ensure that the Department of Homeland Security is able to most effectively protect national security, public safety, and the integrity of the border."

The states argued the preliminary injunction does not impair Homeland Security Secretary Jeh Johnson's "ability to marshal his assets or deploy the resources of" his agency.

The states also said lifting the stay would irreversibly harm them as they would spend millions of dollars in government benefits for individuals that they would not recover if they win their lawsuit.

The first of Obama's orders — to expand a program that protects young immigrants from deportation if they were brought to the U.S. illegally as children — had been set to take effect Feb. 18. The other major part, extending deportation protections to parents of U.S. citizens and permanent residents who have been in the country for some years, was not expected to begin until May 19.

Obama announced the executive action in November, saying a lack of action by Congress forced him to make sweeping changes to immigration rules on his own.

There was no deadline for a decision by Hanen.]

If that's the case then it would be better to ask for a stay with the 5th Circuit as quickly as possible.
